Default Advance Parole for the 2nd time

Hi!
I have searched everywhere but still don't have any answer to my question!
Me and my husband have a pending I-485 and we have current advance parole. But we need to travel outside of the US for couple of months and our current parole expires on March. So we want to apply for our AP renewal, but not sure if we will be charged the $305 fee, since our I-485 is pending. And if we will, is it going to be $305 for each on of us or that's a fee fro the case? Please, any help will be appreciated. Thanks a lot!

Default AP 2nd Time Renewal

Hi,

It depends on at what point of time you applied with Old or New fees structure.

I happen to applied at july 2007 fiasco with old fees structure. Recently I applied AP 2nd time for myself and spouse with the fees of $305/person. It got approved as well.
Applied on December'15 2009 and got approved Jan' 28 2010 at TSC.

If you file the 485s and paid $1010 filing fee (after 7/30/07), you don't have to pay filing fees for any EADs or APs. If you didn't pay the new fee, you need to pay $305 filing fee for each AP application.

Thak you Rajkrish9 and Elaine Martin. We did pay all the fees for 485, and we didn't pay any fees for AP for the first time, but now we are applying for AP for the second time still beeing in the process of the same 485apploval. My question is do we need to pay $305 fee for the second time? And if we need to take biometrics also, if we already did at the first time? And if I'm not mistaken, it is an additional $80 fee, right?

If you didn't pay filing fees for the AP the first time, you must have filed the 485 with $1010 fees. You don't need to include filing fees for any APs or EADs in this case, even 2nd, 3rd, etc filings.

I filed I 485, EAD and advance parole application in July-Aug 2007 under old fee structure. I got my AP from Oct 2007-Oct 2008. I applied for second time for AP with $305 fee which I received and this AP is going to expire in April 2010. I will be applying for AP for the third time. Do I need to add a fee of $305 again. Since I am expecting the Green card to take 20-30 years, will I be required to pay 305 dollars every year to get new AP document. Please let me know. Thanks.

Yes, you need to pay the $305 (or whatever the filing fee is when you file) for every AP filing.

Is it possible to add revised fees for I 485 and not pay for AP and EAD extension fees every year?

No you would have to refile the entire 485 package under the new fee structure. I don't know whether that would be possible or advisable in your situation.
