Default Sending back to India from Port of Entry for longer stay in India

HI friends,

Have you guys heard anything about sending H1b guys back to India if he /she has stayed in India for more than 2-3 months, even though that person has worked from India remotely?

My Employer told me this issue today and two of guys(they are from my consulting company only) were sent back for being in India for more than 2-3 months(worked remotely from India for the same client for 2 months and 1 month was vacation)

This happened in Chicago and NY airports.

Please share if you have heard about it.....Thanks

Never heard of this -

2010 - I was out of the country for over 3 months. Vacation in India + Worked Remotely/business travel in India + Business travel to two countries (i.e. outside US/India)

2011 - I was out of US for over 2 months - Business travel to a country (not India)

On the other hand, you can reclaim time that you spend outside the country on H1.

we are not slaves you know, that we can't go back home for as long as we want. AND if we do they don't let us come back in to work.

I know, its your employer's story, but am sure they were denied entry for some reason other than the length of the stay outside the country which your employer doesn't want to discuss!

never heard of it but definitely interesting if it is infact true (which i highly doubt)

May be,...anyways, the guys are on their way back to india yestrday...I will personally talk to them and update you guys...

upmr,

I'm stuck in India due to PIMS wrongly indicating revoked petition (USCIS says it's still valid as per their system). It's already been over a month and I have no idea how much longer it might take to get out of this mess. Assuming that my visa gets processed, as per your hear-say story, I still have chances of not making into US due to my stay outside US for few months?

It's a creepy thought...I hope it's not true.

Please keep us posted when you speak to your friends.

As far as I know there isn't any law that prohibits a H1-B candidate to not stay outside of the USA for 2-3 months. I am thinking there is a bigger reason than just that and your employer does not want to disclose it due to privacy reasons.
