Default Employer not paying

I work for a small desi company. My employer is not paying me the net amount mentioned on W 2 for the past 2 years.

Will I get all the payments which he owes my if I file a complaint with DOL?
I am scared of losing my status. Like what if my employer revokes my h1b.

Should I transfer to another employer without giving a notice to my current employer.
If I transfer without notice will I be in trouble.
I have no agreement with my employer.

There is another thread I replied yesterday. Read that. It's the same answer for you. Don't be scared. Talk to DOL and they will help you.

Make a trip to your DOL office and file a written complaint. Do something good for yourself and your family. Your child should not think you are a weak person. There are strong labor laws in this country to protect everyone, not just H1B but even citizen employees. The bad employers know that some H1B are without a spine and live a life of fear. They are easy to be exploited. It is a business model of such company to pay you less and squeeze every penny out of you. You need to grow up. You are thinking so much and have so many concerns about going to DOL. Did you even think or have any concerns before signing up with this bad employer? and after you found out, why did you continue to work for them ? Only an illiterate and illegal immigrant might accept to become exploited. You are not that one? If you will not stand up for yourself you will be exploited and abused by others in every walk of life even if you get greencard.

Well he pretended as if like he is paying me. He deposited some checks which were later bounced.

Collect all that evidence. It is a fraud evidence of your employer that will put him in deep trouble.
Nobody will help you unless you help yourself. What is stopping you from going to DOL with a written complaint? Discuss with them and they will protect you and your status as you are a whistle blower.

I have one more question. My LCA has lower pay compared to my W2.
According to my knowledge I think employer should be paying me the amount mentioned on the W2 and LCA shows only the minimum wage.

Am I right?

Whatever is in your W2 should be your take away salary for that month. If your W2 does not match the check you get, it is fraud by employer and you can report it to DOL. Your employer will be in BIG trouble.
