Folks, the India queue is very huge. And there is no miracle except for the fact that spillovers happen every fiscal year end and eb2 moves forward.

With PD porting, eb2 India will be slow till the last quarter.

One good thing is, during recession not many eb2s were filed, so the 2007, 2008 queue will be comparatively smaller and spillover rate maybe be high.

Eb3 India - the numbers are very high taking into account, most people wanting to Immigrate via EB based, are in the eb3 category only.

So, what IV tells everyone - is what I repeat. Meet your law makers and participate actively in IV campaigns for relief.

Default Can some one please clarify as this is confusing and i am new here

If the India queue is very huge and if spillovers happen every fiscal year end and eb2 moves forward first, how is it going to help EB3 even if we meet law makers and participate actively in IV campaigns for relief. Any relief will generate extra visas which wil be all consumed by EB2 and EB2 is at a point where the demand for it will only go one way and that is up. Any one applying for GC now will not apply in EB3 as he/she knows that EB2 is a better bet and hence there will be always some one in EB2 wating for GC before EB3 can be considered for extra visas. Also with porting the EB2 queue is going to be filled up more.

true so we need to explain this to lawmakers. We need to remove per country logic and also our best bet is to remove 1,40,000 limit for EB category so that all categories can become current.

Please bear with me if i look like i am nitpicking but ..

If everyone remember the old rule where EB2 and EB3 were equally getting the extra visa and then someone (I am assuming IV Core but I could be wrong) identified that the law was being interpreted in a wrong way and that the correct interpretation was for EB2 to get all the extra visa and only if EB2 does not need those extra visas will any extra visa go to EB3. USCIS agreed and made the rule change to implement the law correctly.

Now if I remember there was some discussion on this forum to get this law changed back to the way it was done originally but the reason given by IV Core and all the learned people out here on this forum was that US immigration Law is the Law and it cannot be changed.

In the same context how can the below 2 laws which are US immigration laws and thereby as Sacrosanct as the EB2/EB3 rule logic law be expected to change despite meeting with law makers and policy makers

- Per country logic
- 1,40,000 limit for EB category

After all US immigration law is the law and the above 2 rules are major rules in place since immigration to US started. Changing them is like shaking the foundation of immigration law and is not something which will happen in just one congress session and by tabling a bill and expecting it to pass how much ever lobbying is done for it

If explaining to lawmakers can get the law changed (Which i see no chance of but am willing to accept as a point) would it not make sense to get the smaller laws changed instead of trying for the big ones.

Default roller coaster is better

Puzzling dates are better than strategical dates. We used to get like this before. That way either eb2 or eb3 or both may give some surprises on dates. We strighted out the USCIS/DOS to be perfect on EB3 dates but not on eb2 dates. Love to see both to be magicial rather strategical. Anyway just kidding if you understand.
