Default Does NSC has any expedite program like TSC PLUS Pilot?

Hi Friends,
Can you please provide advice/suggestion on my case:
I am a 2007 July filer of I-485 (EB3 India) and got EAD, AP and I-140 approved in early 2007. I am Still working with the same employer. I have filed EB2 PERM labor in 2008 with the same employer for a different position and got approved last month.
My EB3 priority date is 2004 Feb end and EB2 India processing date is now 2004 Feb 15th (nearly 2 weeks difference). Now if I am applying my EB2 I-140, I think it will easily take at least one year to approve for capturing my EB3 priority date.

1) Shall I wait for couple of months to see whether the EB2 India dates are moving by next one or two months’ visa bulletin, so that if dates are moving I can apply I-140 with a request letter to adjudicate my pending 485?

2) My EB3 485 is pending at TSC though my company is under Nebraska Service Center. So, if the date become current for me may be by next visa bulletin, is it possible for me to use TSC PLUS pilot program to expedite my case?

3) Do you know whether NSC has any such faster processing programs, if the applicant’s priority date and received dates are current, in order to adjudicate pending 485 case while applying I-140 itself?

Or do I have any other options for a faster processing….

Thanks.

Immi_chant,

I think u have very good chances of approval with TSC, since they are holding your pending I-485.

Request your atorney to file the new EB-2 I140 at the TSC and send a letter highlighting you r porting your EB-3 PD of Feb 2004.

If you have everything u need to be qualified as EB-2, i think youurs will be approved using their Pilot Plus program where they adjudicate both I-140 and I-485 concurrent.

wish you good luck in your quest for porting the PD.

Hi Rajuseattle and ValidIV,

Thanks for your advice.
Yes, I will qualify for EB2. Actually my PD is not current as on now (nearly 2 weeks difference). If by the next visa bulletin, EB2 India dates move forward by 2 weeks, my priority date will be current (also the received date).
My attorney (actually Employer's attorney) planning to apply my EB2 140 now to NSC since my employer will come under the NSC jurisdiction, even though my EB3 485 case is pending at TSC.

So, is it quite OK to send EB2 I-140 to TSC though employer come under NSC?

And do you know whether NSC has any such expedite programs?

Hi Sweet23guyin,
You can get info about TSC Plus Pilot program from http://www.murthy.com/news/n_tscpls.html

immi_chant,

Its Ok to apply your new EB-2 I-140, but remember NSC is notorious about spoiling the party for EB-2 approvals, but at the same time if your case is straight forward and you are confident you r well qualified for EB-2, go ahead and apply it to NSC, request your attorney to do some personal or AILA level follow-up with USCIS I-485 adjudication division for porting your PD.

Good attorney can do this follow-up jobs very well and they have the resources to work with USCIS-NSC liasons to speed up processing.
