I would be inclined to say Yes, she can if she is eligible. Multiple immigration applications are allowed as per my knowledge, since they are for a future job opening. This is just an advise and I am not an attorney.

You can also try posting your question on www.avvo.com and see what the attorneys there suggest. Good luck!

Default EB3 derivative applicant to EB1 primary applicant

Hi,

Please let me know if you have any information on this.

I am EB3I 2006 (I am the primary applicant) and we are in EAD.

My spouse is a derivative applicant (EAD), is she can file EB1 now? If it is Can I be a derivative applicant for EB1?
