H1B(i-140 approved) To H4(EAD) To H1B
I am looking for an advice on the below situatation.
Currently on H1B 7th year, I-140 approved with priority date in 2013.
Lost the job, is it safe to move to H4(take a break in employment) with EAD through spouse H1B or get a new job immediately and move to H1B.
If moved to H4 now and get back to H1B later,
-Will the applicant loose the approved i-140?
-Can the priority date be captured during the GC filing by the new employer later on the process?
Anybody who was/is in a similar situtaion please let me know your experiences?
