Default Pre-adjudicated cases July/August 2007 Filers

As per USCIS processing time/volume data (I485 February 2010) for Texas, Nebraska and National, we have following volume for pending and Pre-adjudicated cases waiting for visa numbers:
Texas, Nebraska, National
Pending 20,215 - 21,905 - 158,010
Pre-adjudicated waiting for visa number 86,062 - 96,053 - 207,356

Is it safe to assume that July/August 2007 filerís case has been Pre-adjudicated and is waiting for visa number at this time (because of priority date) ?

My assumption is based on the following:

Texas and Nebraska service center processing times are October and June 2009 respectively.

If processing center has passed filing date (July/Aug 2007) then one should have received either RFE by now or case should be among Pre-adjudicated cases waiting for visa number.

It does not make much sense to me that July/August 2007 filerís application can be among pending applications because the processing centers have well passed July/August 2007 dates and should have approved, rejected issued RFE or should have moved application to Pre- adjudicated cases because of priority date.

I also remember lots of applicants received REF in 2nd and 3rd quarter of 2009.

Any feed back ?

I agree with you. Few of my friends have received RFI and they also July 2007 filler. So you defiantly make sense.

is there any LUID on your case - if Yes - its pre-adjunticated, No - talk to your attorney.

I had a LUD on my application (including dependents) on same day in June 2009.

I am confused. Does this mean that there are 200,130 cases pending (20215+21905+158010) and 389,471 cases pre-adjudicated (86062+96053+207356)? Is this just EB demand or does this number also include FB demand?

It is I-485 demand and I think this is for both (family and employment based).

As it sounds ďpre-adjudicated waiting for visa numberĒ means application is subject to visa number availability and it has already gone through all other checks and has passed all formalities including name check

Nabeel:Your logic assumption is wrong.There is no LUD for me ,but when I called USCIS rep told me that our family all three I-485 cases got pre-adjudicated.

Murthy, It is good to know that your case is among pre-adjudicated cases and you are a July 2007 filer. I do not remember saying that if you have a LUD then your case is pre-adjudicated but I did answer a question from Kirthi confirming I had a LUD during 2009.

I do not have a problem admitting my logic is baseless but I do see your post confirming pre-adjudication of your case does endorses my assumption/logic.

I guess your post does confirm that it is not necessary that one will have a LUD on the case for pre-adjudication.

Can you pls. provide the phone number for USICS along with options so we can also benefit from your experience?

Default Preadjudicated

If your I-485 is preadjudicated what case status do you see on USCIS website ?. I had filed mine on July 2007, I had seen many soft LUDs on my I-485 but case status is still "INTIAL REVIEW".
I guess I need to call USCIS to know the current status.Any inputs would be appreciated.
