Post We need EB Visa spillover by PD

Now it is very clear there will be no immigration bill of any sort in near future.Politicians always talk about undocumented people for the obvious political gains. IV should focus on requesting change in visa spillover at least among EB category strictly by PD. I think not sure no congress bill needed for this to happen.

If things do not move I see more stronger IV coming into action, after all IV is us.
I recall , the spill over method was just reinterpreted but not rewritten, hence it did not required any congressional changes. Just like Immigration bill is more favorable to deal in piecemeal, so does our agendas. I think of a timeline to stay in queue.
For example. there should be no more than "n" years between a any oversubscribed country to non-oversubscribed country or oversubscribed to oversubscribed. This will reduce the length of long lines to short lines, not affecting dramatically to ROW.
Its a convoluted formula but , i feel its a method that is not going to change anything drastically , but greatly helps ever long growing Eb3I queue.

Best things we can do is, pass USCIS administrative action, to recover all the unused visa since 1992.

This will wipe out all of our problems and it is possible without congress.

If there is a family of 4 , a EB visa number is allocated to each and every member of the family instead of 1 visa for the primary.
In H1B visa ,a visa is allocated only for the primary against the total visa cap.
Does removing the rule of allocating a visa number to each derivative or dependent in the family need a change in the law or can that be done via an administrative fix?
I am sure nobody from any country or any EB visa category will oppose if that is done.
IV must surely be working on this but I am not sure if it is getting the attention it should .

Default I agree with murthy, there should be visa allocation on PD seniority in all EB categ.

Yes I am in agreement with you murthy this is more sensible and realistic to all of us. First come and first served basis. ir-respective of EB1, EB2, EB3, and others. Visa # should be allocated according to priority dates. And not on who has masters and who has higher level position in job and who is making more money.
Its simply make more sense and humane.

IV should more stress and promote this issue simple and straight forward.
this way there will be no wastage of visa # and every one will be treated fairly.

I +1 this. Something REALLY worthwhile for IV that will benefit everyone.

Of it IV doesn't like it, I will suggest a personal agenda:
Grant gk_2000 citizenship right now even without having a gc. gc-exempt honorary citizen. I hope you will pursue it

Default Visa Allocation on PD basis is sensible and dont need any approval from Congress!!

Visa allocation on first come first served basis.
why discriminating on which category one is eligible for on education and job basis.
This is land of Liberty and fair trade. why such discrimination and dive and rule policy.??
Look at cutoff dates of EB3 I isn't it shameful and pathetic on their condition just because they were not eligible for some other category???

IV administration and senior member please bring this issue up. With this all people will be benefited . We don't want to step on each others toes.
simple as " first come first served" rule of fairness and equality.

I do not think you know the powers of that office. They cannot even change any law or change any memo. There is no power to change or even influence. You got a standard template letter and are unnecessarily getting excited. I have been there and done that.

People who do policy work are either working at the White House or leadership in DHS. If you attend an advocacy day and get tutored for one full day on how government works you will start to get kindergarten knowledge of the country. I was not aware of different arms of government until I attended it. I used to think what I read on websites is the truth.

Not getting in war of words....i have been to advocacy events, have met law makers....and done all that...my point is, we should try available options.

Nothing will happen politically if it does not result in votes! Even killing of 26 children in a school has not made the lawmakers to fight NRA....

my point is try all options, administrative fixes, write letters to ombudsman etc etc...If more and more people write letters, someone will take it up and take action. In other words, better to take it to USCIS for admin fixes than to lawmakers!
