I agree with this one sentence, though.

In defense of employers (OK, I'm ducking now for incoming missiles), it may seem contradictory, even ironical to many, but the bigger one's employer, (and that, for some reason, though not always true - implies a more neutral (disinterested?) employer - don't ask me why), the less the involvement of HR with the details of immigration rules. They just hand it over to the law firm, typically the biggest and the most well know around, and let them handle it all. I'm sure many here identify with it. The problem here is that if the lawyer screws up, there is absolutely no one in the company who in understands what is going on. The employer means well, but there is no "person" as such. We are talking about a whole HR division here. And while the said victim is battling, the whole case is determined by a faceless paralegal somewhere in the city.
In this scenario, the best the poor victim can do is wait until everything is filed before "outing" the law firm. In this respect, I agree that many incidences of lawyer's incompetence will only be revealed after August 17th.

Default Missing Initial Evidence

We just got a copy of our I-485 application from our lawyer and saw that they did not send out the affadivits of birth we got from India. My (primary applicant) birth certificate does not list my mothers name and even has my birth day (incorrect one) crossed out and the correct one is written to it's side with a signature from the person making the cert.

Does anyone know if this is an RFE or is this grounds for rejecting the I-485?

Not so much with immigration attornies more with Visa Specialists, There is a UK guy Named Doug Hall who went to the UK to drum up immigration clients.

He was not a business broker, nor CPA nor immigration attroney yet he conned 25 plus victims out of between $250,000 and $500,00 each

He was sentenced in Bartow court on 7th Aug to 23 months plus 15 years probation. This was for ONE case only !!

Further charges are pending !!

Stay away from that guy.

Back in 2005, he spent almost 3 months to define my job description for my labor certification, never answered my phone calls, and one of their nasty coments were "Dont you think is too soon to apply for your GC?" was my 2nd year of H1B....

At the end of the process (I fired him) but I was not able to recover $2000.... now in 2007, I really regret not the $ 2000 but the time lost with that idiot, in 2005 my category was current and thanks to him, I'm now lost in this mess of priority dates.

So, run away, the firm : SternElkind (Denver Colorado) the name of the Idiotic: "Brad Hendricks"

Default a history of negligence and imcompetency

Dear all,my story basically tells you that 3 years ago I hired a lawyer to help me obtain the green card. One of the most expensive lawyers and well recognized firm that I found in Washington DC. just after one year and half they were "kind enough" to start my process after some calls and emails that I sent in desperation. They filed my PERM which I just got approved! however, they just call me and told me that they have made a mistake and that we needed to file again. This made me miss the opportunity to file before Aug 17 and now I have to wait for the priority date (if it ever comes)!!!! I wonder if I can suit them or complain about their malpractice with someone? Can you help me find this out? i have a very little salary and despite my restricted income, I'm paying them on time. What do you suggest?

Default Should I fire my lawyer?

Am a newbie to the forum and just discovered it via a friend in a similar situation as ours.

We applied for a GC November 2006 and are waiting for our reply for the I-140 approval. During the process of application, we have been very disappointed with our lawyer's incompetence in handling our case, i.e, not returning phone calls to questions and being callous with our situation.

Over the course of this process we have been seriously considering terminating his services even though we expect our I-140 results in approx one month. The catch is that we have to pay him half of the fee if the result of the I-140 is successful ($3750).

Should we wait for the I-140 results before terminating his utterly incompetent services, or will this have legal implications against us?

Our other option is to stay with him until the result of the I-140 comes through and decide at that point and time which course to take.

This leads to a question of whether it is possible /difficult to continue our petition for the GC on our own as our faith in lawyers is completely tarnished.
