Default Bill to give DV numbers to EB!!

Rep.Darell Issa (NY) has introduced a bill to end the Diversity Lottery program and give the 55k visas to EB applicants with advanced US Degrees. This is a pretty exciting development (at least to me).

I think this is a great starting point that we should all jump on to clear EB backlogs.

He is from CA...not sure where this came from...looks like political posturing but good to know someone trying to address EB backlogs...I'm sure that IV leadership is aware of this development - thanks for sharing!

I am surprised that this is not getting as much attention as it should.

IV Team, is there anything we should do to work towards this ?

Thanks.

Default Is it only for math/science workers?

I might be wrong, but I read somewhere that these numbers would go to those working in math or science related fields AND who had graduated with a related degree in the last 5 years.

Again, I'm not 100% on it, just wanted to check if anyone else heard the same.

Default Complete Text looks good

Bill Text - 112th Congress (2011-2012) - THOMAS (Library of Congress)

That link has the complete text. Relatively simple text. Includes those who have completed degree in last 5 years or those who have resided in the US since obtaining a degree.
Only one constrain. Requires that "will substantially benefit prospectively the national economy of the United States". The second part is something which is fuzzy and not sure how USCIS will interpret it. They might apply the logic of EB2-NIW. However, in either case, it is adding numbers of EB categories and hopefully rest of the bill is allowing for these numbers to fall across and down.

If the applicant has completed masters degree in U.S. after filing Labor /485, does he get benefited with this bill ?

Thanks,

This would be a great benefit to all the applicants who have worked their asses off to get a Masters or Doctoral degree in the US and have been waiting in line forever now.

In the three days - Jan 5, 6 & 7, there were 75 bills referred to the House Judiciary Committee. This was one of the 75. Very likely, this is just posturing and nothing more.

Default Why/how will they listen to us?

Besides no one is going to listen to us unless we maintain a long term relationship with many lawmakers by meeting them regularly all across the country. only then will they listen to us as representatives of IV and introduce Bills like this and co-sponsor and vote for it. It also has to do with building relations and trust.
Thats the only way to get them to pass Bills for us.
This is a process that can take months of work to get a Bill introduced and get enough people to vote for it.
Just calling them at the last minute and saying 'lets push for this' or 'why is IV not acting' is not going to do much help without the previous step.
This is an ongoing process that needs to to be done over a long period and its about getting enough votes in house and senate 216+60 to pass. that is how we ensure close to 300 lawmakers will vote for our cause.

Default 5 yrs or Continuous stay since obtaining degree

I got my US Masters degree in Engineering in 2002 and I was obviously concerned that I would be left out if this is limited to people getting degrees in last 5 years. I read the text and here is the crucial part for people like me:
"(ii)(I) obtained such degree within the United States during the 5-year period preceding the date on which the petition filed under section 204(a)(1)(F) for classification under this subparagraph is filed; or
(II) has resided continuously in the United States in a lawful nonimmigrant status since obtaining such degree; and"

^^^ Very well said...Right on target. Also I would add to 'learn the ropes' we (as in volunteers) can take up the I485 initiative and work towards its success. That will certainly give us valuable exposure to build long term relationships with lawmakers.

The "5 year clause" is definitely a blow to everyone who has been waiting in line forever.

I think this is the right time to not only run with this but also work on modifying the text of this bill. IV Team, could someone please give some feedback as to what you think?

Thanks

It says

ii)(I) obtained such degree within the United States during the 5-year period preceding the date on which the petition filed under section 204(a)(1)(F) for classification under this subparagraph is filed; or

`(II) has resided continuously in the United States in a lawful nonimmigrant status since obtaining such degree; and

Bill applies to anyone who got their degree in preceding 5 years or resided legally since graduating (even greater than 5 years) will be eligible under this bill.

But, we have to figure out what is "resided continuously" and hows that is defined by USCIS.

Is it worth contacting lawmakers about this bill?

Default One more section

(iii) whose services in the sciences or medicine—

(I) are sought by an employer in the United States; and
(II) will substantially benefit prospectively the national economy of the United States.

I am not sure how USCIS will interpret the above section as well.
