Thumbs up Draft text of Senator Specter's bill

Thanks to gc_check for posting this info here

The pdf doc is here and the main stuff starts after page 181

This is a really long document...but a few things that I glanced through are

1) Advanced degree in STEM + 3 years work ex = no numerical limit
2) Total EB category visa bumped up to 290,000
3) Dependents not to be included in numerical cap

All of this is good, but lets not get too happy so soon. Remember S.1932? We need to make sure that we keep the pressure on the lawmakers (who are pro-immigrants) not to budge this time in the conference committee. At the same time, we need to try and educate the anti-immigrant lawmakers that we are not ILLEGALs.

Do your bit: Recruit friends to join IV, volunteer by contacting lawmakers etc and contribute. Together we can win!

In any case, as per Shusterman.com, this bill will be tabled to the Judiciary committee on March 2nd. Today is Feb 24th. That leaves us only THREE working days to pass on this information to the committee members. We need to do something drastic to make our point.

All the members of IV, wake up! This is the time to fight. The anti-immigrant lobby will be getting very active in the next few days. We need to do the same

Default Experts, please comment

Please take a look at page 249. If I understand it correctly, it mentions that the quota for EB1 goes from 28.6% of EB visas to 15%, EB2 goes from 28.6% to 15% and EB3 goes from 28.6% to 35%

That means they WILL create a new category of EB visas since they have to utilize these extra visas somewhere!

Am I reading it right?

Default Countrywise cap set to 10%, not eliminated

Hi,

In the draft, the countrywise cap is set to 10% of the quota. That's still a big stumbling block for Chinese and Indians.
We should push for getting rid of this countrywise cap.

Another, just a thought. Once they increase the cap and all those changes, so many people will be eligible and apply for 140 & 485. They will become eligible for EAD and AC21. The USCIS will drown in I140 and I485 applications and recurring appls for EADs resulting in huge administrative delays. So the spead gained by legislative action will get lost by backlog due to administrative actions. Classic case of give by one hand and take away by another.

Any thoughts?

Hello everyone,

There is no need to get excited. How much we can achieve from this will depend on our efforts.

Please contribute to Immigration Voice if you really want something to come out from this markup. Be generous by the way.

Cheers

Oh actually I was working with Spector so that we can have markup out asap. Just Kidding. Got busy with work.

Any way fox please wake up now. It's a show time. We have 27 days left. We all have only one option and that is to "Kill Retrogression virus". There will be no negotiation on that.

Cheers

I believe that the visas made by cannibalizing EB1 and EB2 will go to the EB unskilled worker category. It would be terrible if the quota is not increased, if advanced degree+3 year people are still subject to the quota, but if the visas are reallocated.
