Cool Future STEM EB2 gather here - CIR 2013 impacts

On Page 2 of IV provided summary of bill ( http://immigrationvoice.org/wiki/ima...visions_IV.pdf ) it says that US STEM do not have to go through Labor Certification.

"No Labor certification for US STEM: Eliminates labor certification requirement for advanced degree holders in STEM fields from a U.S. university."

1) Has the advanced US STEM degree have to be in last 5 years ?
2) Which section of bill is this covered under ?

I completed my Masters in 2003, I guess that would eliminate me from the STEM quota

I also finished my MS in 2003 and had this question when I read this line….later on one of my friend clarified this and said it means US Masters should be at least 5 years ago.

Please contact senators and congressmen of you state immediately to introduce amendment to remove this 5 year condition. Also immediately contact your HR to petition to senators. Be humble, polite and logical... Do this NOW!!

Also, be specific about the terminology of bill I.e page/line number of bill you are referring to. I think it is page 305, line 10. Please check..

I see lot of posts/concerns on IV regarding the 5 year condition. All those should contact senators, congressman and HR immediately. ADMIN2 from IV has already expressed support for this commonsense and logical amendment....

I am in a similar boat. The clause in page 305 states that the petition should have been filed within 5 years of obtaining the Masters degree. It does not mean that the Masters degree should have been obtained at least 5 years earlier. It is a bummer for people who could not file their GC petition due to several reasons within 5 years of graduating. I agree that this needs to be raised with the relevant people who can gather feedback on this.

Folks - the other main thread that is discussing announcement of the bill as well as other high-skilled provisions is the relevant thread to discuss this. We have volunteers who are collecting feedback in a specific format regarding proposed amendments that other members are proposing.
Due to IV members' grass-roots efforts and our persistent advocacy, most of our provisions are in the base bill but of course there is lot of scope to make the bill better from high-skilled perspective.
If you have a reasonable change/amendment/idea please add on that thread and our volunteers will compile it into the growing list.

We are well aware of the 5 yr condition and as beign discussed on the other thread, are compiling several other suggestions from our members (some are already on our list and some are good new suggestions).
AIs like calling lawmaker offices or visiting should be done in a coordinated manner. IV action items announced on the forum are always strategically timed to create the most impact. We appreciate your initiative...and advise you to contact info@immigrationvoice.org if you want to particiate in other IV grass-roots efforts that are ongoing now. Because if you do go to meet a lawmaker office, you will have to use specific messaging that we can help you with or else the message will not get across. Individually calling any office to point out a provision or an amendment will not help since the message will just be lost in the noise.

I'll repeat my question again. Which section or page says "no labor cert for US stem". Please do not confuse this with 40% quota provision which is separate and is for US stem in last 5 yrs. that is on page 305. But where is the no labor cert provision mentioned?

Help Us Improve the Bill - Immigration Reform Facts - U.S. Senator for Florida, Marco Rubio


I have put comments on removal of 5 year limit for STEM in page 305 of S744 in the above URL.

And also requested STEM with 10+ or 15+ experience should be exempted from numerical CAP like Doctorate Degree.

May be more people add thier commets the more can be effective

Just curious any body knows about the status of S169

It will remove CAPS for STEM Masters and Higher,
Spouse and Children

and I think Conuntry CAP too...
