I saw this last week on USCIS site and since then struggling to understand one point. When DOS publish certain VB (Final & Filing Dates) and after a week if USCIS publish their bulletin and if it has different dates than DOS VB, Is it legal to do that? Is there a law around it? I am no attorney but I thought DOS is authorized for the bulletins so if uscis is taking control of filing dates and change them as they wish, do they need rule making for it? anyone?

Default Fun idea while everybody is waiting

I think we should all work together to pause all Immigration until this problem and solution is figured out. We can stay in this temp state until then, The moment attorneys stop getting any money during this pause period they will be hurt and solution will be faster.

DOS VB still is valid and it sets both dates as the orignal source. USCIS decides which table (date of filing or final action) will be used for a particular month for accepting application.

In hindsight, we were better off with the good ole’ Charlie O doing his once in a while magical date movements like he did in 2011/12. If nothing happens to VB reversal in the short term, we are f**cked once and for all. I am still thankful to IV folks for their hard work on this and the Administration for the well intentioned move.

So are we done?

May be USCIS wants control of Visa Bulletin. But god knows how these things work.

Yes we are. The lawsuit did us in. If there was no lawsuit, things would be different today

I think you misunderstand. USCIS will not publish "new dates". They will just say which table they will use. See my response above.

About legal/illegal, the court statement said they are no laws for VB as argued by the Government. I think all this is in unchartered territory.

If USCIS takes control then immigrants getting GC in MARS will be much easier than in US. They don't know how to count and they will simply waste visas.

Ok, Make sense! However, what if they say we will use SEP 9th VB filing dates i.e. 07/11? Just asking

They need time to review the DOS data. May be this is a way to not get any lawsuits in future. They can say in future We will only use the GC acceptance dates and not filling dates.

I think this is just a mechanism to make sure the DHS has some say in the VB movements.

They will typically just rubber-stamp the DoS dates unless DoS makes a huge unjustified (in DHS view) VB date move.

If DoS makes another big move in VB dates like the 9/9 VB, DHS will just point to the Final Action Dates - which will effectively retrogress the dates.
