Thanks for posting the visa bulletin so quickly. You beat the Mathew Oh breaking news as well.

EB2 moved to 01-Aug-01 and EB3 to 01-Jan-00.

Good news for EB2 and not much improvement for EB3.

Default Ambiguous as usual but a ray of hope?!

The movement of Employment cut-off dates during the past several months has been greater than originally anticipated. This has been a direct result of low visa number demand by Citizenship and Immigration Services (CIS) for adjustment of status cases. It is not possible at present to speculate how soon CIS number use will significantly increase. Once increased demand does materialize, however, cut-off date movements will necessarily slow or stop.

Hold on to opening that Champagne bottle my friends.

I would love to have 7 month progress each month, my PD is Sept 2004 in EB3 but I am expecting a HUGE slowdown around April 2001 and God only knows how many bulletins will be there before we get over it and how much wait even AFTER THE APRIL 2001 hump. We dont know anything.

As backlog in labor is relieved the pressure is immediately transfered to EB retrogression. Backlog elimination centers having not been very efficient. If they are, then that was cause retrogression again. I guess the PD would YO-YO back and forth before BECs in Philly, Dallas etc are Finished processing all dusty old labor files.

I wouldnt be positive before the labor backlog centers actually start showing REAL progress. That is the true test.

guys..

Read from oh-law, that i245 cases in April 2001 will fall in EB3 category...
then eb3 will get stuck in April 2001..

Please comment on this...

there is conflicting views on this but yes, it MIGHT slowdown the movement a lot. assuming a 7% country cap India/China have been getting most of the visas from the recaptured pool every year for the PD to move up. However I am not clear on how the reallocation of recaptured pool is done but I know for sure it country quota independent but I don't know how it gets distributed between EB3 (Skilled, Professional) vs EB3(other) category. If the recaputured visas are not allocated with percentile quota as for teh annual visas whereby restricting EB3 other to only 10K per year then we are doomed. can someone please comment on this further.

I sent in email to murthy.com and oh-law for further clarifications..hope they post something about it...so many people fell in that category during that period before 2001-2002...

If it was now.... all of us will fall in EB1 with all the experience gained since then

Have a question too, when these illegal filed their papers, I am sure there wud be column if they were out of status..illegal..amnesty etc...

We need to be separated from these guys...maybe Bill Clinton shud raise the quota for them..

hi techy
one thing is clear the unused visas are country indepedent and are used at the rate of 27% per quarter.
so for example 100K visas are available (which i would enjoy having )27K per quarter is available from the start of the year . Now among this 27K how is the distribution, can it be distributed whichever applicant needs PD IRRESPECTIVE of EB1,EB2,EB3(skilled, professional) Vs EB3 other or does it split by the calculations of EB1, EB2, EB3 with some 28% EACH and EB3 other NOT above 10K limit

If the answer to this is the former then we are doomed no matter if the immigration reform happens or not bcos of the 245i load. However if it is the later then we MIGHT benefit since the redistribution number to H5 visa holders have to be evaluated. But if the spouses, children are exempted then we will certainly benefit a little more.

What will happen name check for those 245(i) cases? There's going to be huge traffic. That may cause further delay??
