Default Ombudsman Reiterates Multi-year EAD Recommendation

Thanks for posting that link, Bee.

I think it validates our strategy of pushing for a legislative change as well on this issue, in addition to an administrative push on USCIS. If Congress mandates that USCIS issue multi-year EADs and H1Bs, then USCIS has no choice but to do it, whereas they can drag their feet right now as long as they have the option.

It also validates our goals because we have been pushing for multi-year EADs and H1Bs on the premise that USCIS will be freed up to process green cards. It is good that the USCIS ombudsman thinks alike.

The ombudsman is a Desi...and seems to be making very sensible recommendations...we should probably ask him if there is any way his recommendations can be seriously considered by the USCIS. If he requires statistics to show that people wanting to renew EADs are willing to pay more, then, that kind of data will definitely help. He has demonstrated this in the past by drawing an analogy (i'm saying it again here..sic) to the H1 premium processing program.

The Ombudsman's 2005 report has precisely this kind of analysis (see link in resources section in lawmaker resources). We have also spoken with him about these issues -- writing a memorandum is the first step for serious consideration by USCIS.

But remember, that if the USCIS does this on a discretionary basis, it can easily revert to single year EADs on a discretionary basis. We are also trying to take the choice out of the hands of USCIS by writing it into the law.
