Conclusions
  • This year ROW took a very big share of the pie (most retrogress did not hit the threashold except for EB1-I/C EB2-I and EB3-P)
  • EB1 usage was high.
  • No visa wastage, they issued 141043 total visas.

USCIS had so many Eb1 and Eb2 applications pending at various centers before all these pre adjudication process they started. After Pre Adjudicated of lots of cases they consumed lots of visas this year. Now that if we get new backlog report from USCIS and if they give true report then visa usage for 2010 for ROW countries should not be higher.

We should notice how country cap is affecting us. IV is fighting for removal of country cap. We should join IV on this one.

Every Year South Korea gets more than 7% visa in both Eb2 and EB3. South Korea should be retrogressed. In fact in 2009 they got 3,571 EB3 Visas and India only got 2222 Visas. Simillary South Korea got 4991 Visa in EB2 and China got only 3046 Visas.

I think its not legal to assign Korea more than 7% visas is other countries are retrogressed.

Also Philippines was assigned 5266 EB3 Visas which is also wrong.

hmm,, I think I am totally confused with the reports. DOL reports vs USCIS reports. Can someone explain whats the gap/ Or they two different types of reports? I am really scratching my head.

this is DOS report.... which shows how many EB visas they allotted in FY2009. USCIS report is for pending 485 applications......

Thumbs up 10K visas from Family to EB for FY 2010

10K visas from Family category to Employment for FY 2010. That's good news. So EB2 will get 7k extra visas provided EB4,EB5 and EB1 don't use them.

However we think of it, the fact is EB3 I is screwed a BIG time !!!

I sent a couple of emails to our Congressmen on this issue, and I am going to meet him personally with a few other folks around here to discuss about this issue.

I think everyone should come forward and meet their congressmen and get them to know how screwed we are and associated problems we have. Not specifically EB3, but as a whole.

Don't flash me saying "We are small in number", "we don't represent a bit vote bank", "they have bigger issues to focus on than this one", etc stuff. We can make an impact!

What I understand is in year 2008 (http://www.travel.state.gov/pdf/FY08-AR-TableV.pdf) the numbers were more for India:
Country EB1 EB2 EB3
India 5,326 14,806 3,575
Total : ~24 K
Where as in 2009:
Country EB1 EB2 EB3
India 6672 10124 2306
Total: ~19 K

Agree with spicy_guy and others too. The only solution is come forward rather than expecting somebody else will do it for you.

The way forward is to educate our lawmakers. Please take time out to visit your local house rep or congresswo/man's office. It hardly takes 30 minutes. Please educate them on all the issues. IV advocacy packet is handy, take it with you.

How do you infer the 10K family based from FY2009 will go to FY2010 EB category? Can you explain how this works?

You have not included EB5 which totals to 141043. Look at the grand total at bottom of the report.
