I have a verbal commitment from my current employer that he will NOT withdraw my I-140 application whatever the outcome (layoffs going on).

I guess I am one of the lucky few!

I was in a similar position. What is most important is that your i-140 is approved!

Default Change to similar job within the company post 485 filing?

My I-140 is approved, I485 petition filed in July. I am looking to move to a different group within my company, same job/title/responsibilities -

Can someone comment on risks if any with this?

Also, there were some comments on this thread as to one should not do H1B transfer if one needs to change companies (similar job responsibilities ofcourse) post I485 filing within 180 days of filing?
  • Is this really a big issue - should one instead move on EAD if one is changing jobs/companies within 180 days of filing?
  • If EAD is not an option (not arrived yet) or due to the same reason given for not doing an H1B transfer (this way you are informing USCIS of change of job and it might lead to a rejection of GC since it is within 180 days), is it okay to actually sit at home until 180 days are completed and then change jobs?
  • It seems like there is a risk if I-485 petition is approved within 180 days and one has changed companies (similar job) or is not working at the time - is this true? or can I-485 get approved without any issues if no RFE/interview requested?
  • How many folks in general get picked for interviews during the I-485 stage?
  • Any other alternatives I am missing that might work for this scenario?

Please advise, looking forward to your input!

--------------------------------------------------------------------------------

great info here - thanks!

I have 140 approved last year, and 485 applied on July 20th.

My employed doesn't give copies or any details about of 140- can I still change jobs and use AC21 to continue my GC?

My contract is ending in Dec 2007, and 180day window is Jan 15th 2008. Am I still ok if I find a new job by December?

Can I apply AC21 portablity without a copy of I140?

Thanks again
