Default Status of Spouse after death of primary applicant

Gurus,

I have a unique position. couple of weeks back I was told that have fatal cancer and won't live pass 4-6 months. After recovering from initial shock I am wondering if my wife will be able to continue her american dream or she will have to head home after me.

I have filed 485 with approved 140 back in june, 2007 with PD of March, 2003

Please help.

Sorry to hear about your situation. I would suggest that you talk to a good immigration lawyer about this.
In the worst case scenario, if your wife has an EAD she can try to find a job and ask her company to sponsor an H-1B.
I hope things take a turn for the better for you and your family.

I think if there is a genuine reason , may be the 485 can be expedited.

1 Could you call up the IO and ask them what to do ?

2 Meanwhile check wiith ur lawyer.

I feel its better for ur wife to go back to the home country ..
May be u too can go now itself and have a good time for the next 6 months.

On the note of your question, I have written to Greg Siskind requesting him to highlight you situation (ofcourse maintaining anonimity) and to suggest any recourse that you might have. Please keep an eye out on his blog and I hope he addresses this.

As a note to all the administrators of this IV forum, I am sure we can pull a few strings to have an attorney provide a free consultation to Mehul .

ALso, Mehul, if you cannot find an attorney who can provide a free consultation, please let me know and I can request my attorney if he would do this favor for me.

HI MEHUL,

Very sorry to hear about your situation.

I have done some research and the closest thing that I came across is as below: BUT PLEASE NOTE THAT IT IS FOR a NON-CITIZEN applying for AOS based on getting married to US CITIZEN. I think there should be some sort of WAIVER for non-immigrant derivatives category as well.

Waiver of joint petition requirement: If the marriage has terminated by reason of divorce, death of citizen spouse, or spousal abuse, the non-citizen spouse may apply for a waiver of the joint petition requirement.

Sorry to hear this news , one of my friend has the same situvation. he went back to indian (chenni Appolo) 2 years back.
Here doctors told him all BS and he spent abt 50k out of his pocket on top the insurance (he work for IBM as Full time). he was told that 2 more months so he went back to india and his parents did giveup and they went to take a secound openion he is perfectly allright now he said he will never come back to usa (some unique bactiria causes some kind of cancer i have no clue about what he told me that time and i dont remember exactly contact him raviselvam@yahoo.com or raviselvam@yahoo.co.in if you cant get hold of him contact me bhimireddy@gmail.com i will try to reach him i should have his contact info. hopd you will recover soon

Really sorry to hear that but i do believe that with medical advances you will have a chance. Try to seek best medical care and advise. As others i suggest making an info pass appointment and discuss with an IO i am sure they will help.
