Default 11 years and will wait for another 13?

Arrived in US Aug 99.

Couple startups went down, and finally filed in EB3 category, PD Feb 2005.

Current calculations, should have adjudication by Oct 2023.

HaHaHaHAHAAHAHHAAAHA

Surely, it's been a joke.

Glad to see there are people like me on this thread. I came to the US in FEB 1995 as an undergrad. I have an MS today and dropped out of the PHD program (2000) to find a job because of recessions. Survived 3 top-notch companies, recessions, despicable back-stabbing coworkers, unethical and unworkable environment, lay-offs, legal dept messing up my H1b application making me go on unpaid leave (~3wks) without health insurance, filing me under EB3 while applying EB2 for another coworker from a diff country with the same job title, etc etc....my rear end is pretty soar these days and I am beginning to question all this....

i usually dont post much...but I couldnt resist this thread

Sorry to say but your are in deep shit if it goes the way it is going. If let say Eb3 moves 1 year every 3 years. You have 18 years to wait.
Please upgrade to Eb2.

It will take another 9-10 years to get your GC if the system remains the same.
Please upgrade to EB2

Landed in july 2000

Changed employer in nov 2000

Joined a fortune 10 company in aug 2001, they had a policy to wait for 1 year before any GC application.

Started process in August 2002, Finally labor was filed in March 2003

May 2004 Company bought another company and in merger my department was closed, Was laid off in October 2004, was lucky enough that a job I had interviewed internally came through. Started with them in October 2004 but with a 20% salary cut

Finally labor was approved in 2005.Got 140 approved in Jan 2006.

Dates became current in June 2007 but lawyer delayed the filing till July when all dates became unavailable. Due to political pressure dates became current and was able to file for 485.

Got married in Nov 2008.

Company bought another company in 2008 and the merger resulted in job loss again in April 2009.

Was lucky enough again to find another job in the company.

Within 1 month got another job offer in the company with a promotion. So after 2004 came back to original salary in 2009.

Still in 2010 I am not making as much money as I made in 2000-2001 when I had just landed.

Talked to my new manager in Dec 2009 to apply GC in EB2 since it is a VP position with 8 year experience requirement he said a big NOOOOOOOO.

Finally boss agreed to start the new GC in EB2 in July 2010.

Talked to lawyer and after evaluation they agreed that my new job is more than 50% different from my old jobs and hence I can use the experience.

Started the process with the lawyer but since it is a big company all processe take forever to begin

- Came to US in 1997.
- Had Labor + 140 approved in Dec, 99.
- tricked and lured by start-up in silicon valley. Abandoned everything and came to California in Jan, 2000 made the deadly mistake of not taking the copy of approved I-140 (I still slap myself every morning for that mistake )
- Found out they have only one customer
- Founder wasted own 20 Million dollars but never increased the tally for the customer from 1
- "Startup" went under in 2002.
- Joined new company (the only customer of start-up) and filed labor in March, 2003 and enjoying every minute of it...

Cheers

Dude you need to get serious about this. It will take you 21 years if the system does not change. Upgrade to EB2.

Default Are you trying to awake sleeping peoples ?

hey,
It seems like you are inspiring lot of peoples to upgrade to EB2 which is good. Actually saying this and really doing a successful upgrade takes time and depends on lot of things like economic situation.

After my Eb3 I-140 finally got Approved in Jan 2009 , I started searching for employers who would do the Eb3 to Eb2 upgrade .. But there was no job , not even contracts - so who will file a EB2 PERM labor for you in that situation ? Plus if someone files a EB2 Labor just like that - they could be audited. The Job needs to be EB2 level and you need to have Eb2 qualifications which lot of Eb3 has - But both conditions has to meet for a "successful upgrade".

What do you say ? Do you know any other shortcut than what i mentioned - then please enlighten us

Regards,
Diptam

Default my story..

Landed July 1997.
Couple of contracting jobs with a desi bodyshopper(read it as a blood sucker). Believed him for almost 4 years of false promises that they will do GC processing. Finally quit the company and joined a major HMO company. Started the GC paper work in early Jan 2002. Due to the attorney screw ups, and wrong documentation, filed the labor in EB3 (did not even know that upto almost 2 years after filing, was thinking it was filed in EB2) in Jan 2003. Yes, it took 1 year for attorney's screw ups to be rectified. In that company, we were not allowed to talk directly to the lawyer and had to go thru the employer. So to get a simple answer would take 10-15 days. Wish IV was there then. Waited in Labor Processing for 4+years. 140 approved in early 2007. Filed 485 in july fiasco and got EAD, from then changed 2 jobs (got that freedom atleast). Per my own estimate, I should be receiving my GC sometimes in 2015. Current employer will not do GC processing , so no chance of filing for Eb2. I dont want to change employers even if it costs my GC, because, I am enjoying the work that I am doing. And in my opinion thats important because, I would rather be in a job that I enjoy more without GC than being in a job that I do not like with GC. So, 13 years and still going. Completed PMP, MBA meanwhile. Thats my story.

I140 approved - march, 2006.
485 status - Rotting in NSC with a single RFE
Lost H1, working on EAD. Invoked AC21 twice.
Attended DC Rally and contributed to IV many times.
Renewed EAD 3 times and AP 4 times
Total cost from the H1 days (new h1, extension, ead, ap, 140, 485 etc - $22000)
Total cost if I had bought a labor certification those days and having a GC by now - $15000
Not knowing if GC is this worth - Priceless.
