Hello,

Please share your I-140 RFE Experience. What was the reason and how you handled it.

1. If its ability to pay that what was prompted uscis to ask that? Was your pay mentioned in the application was too much or too low?

2.Did you received RFE for education if yes, What was your education. and how you handle that case.

Default My experience

I had an RFE for the ability to pay, PD is sep 2004 , USCIS asked the ability to pay since PD . I have been getting paid more than double the proferred wage since PD so it was easy to prove.

USCIS asked to prove the A2P for all the petitions pending simultaneously and My lawyer handled it very well.

I think NSC routinely asks for the A2P. My lawyers is very conservative he did not even include my w2s while applying 140. His philosophy is dont give any extra info unless otherwise explicitly asked.

Default Paystubs

I had applied for premium processing way back in April 2007. I got an RFE for paystubs for the last three pay periods. I sent them and the I-140 was approved within a week.

Did they asked for A2P before I-140 approval? or at I-485 stage??

I applied for the 485 on July 2nd and the 140 was applied much earlier. I dont think my 485 will touched for an year at least...

Good you bought it up. There are number of people who appear to be getting the I 140 RFE's.

BTW, Any one with Future employment got RFE. I got an RFE but still dont what actually has been asked. got to wait and see. How much does it usually take to recieve the RFE mail since it is updated on the website?

I got an RFE for a2p as well and they asked for my payslips. My lawyer handled it well. The total time for approval was 18months from the time I-140 was applied.

Default RFE on Education

USCIS wanted to prove how my education is equivalent to a US BS degree. I hold a Masters in Computer Application from a good Indian university. My companies’ law office responded to the RFE on time and provided all the course syllabus, certificates and EVALUATION report.

My I140 was approved. It was a premium processing at Nebraska.

I had got an RFE for education. My employer applied labor under EB2. I did my B.E back in India and had 7 years of experience. My lawyer sent new evaluation report and I140 was approved in month.

Folks...while applying for labor I had put a Desi company from India as 1 Year experience.

I got an RFE for I140 regarding my employment with India experience. Since the company no longer exists I am putting an affidavit from my colleague who worked with me.
