Default Campaign?

Why waste time. GC is not end of life. Just move-on. Who knows how the world economy is going to be when we get our so called GC.

Funny question....
How could you switch? You cannot bring down ur work exp. from more than 5 years to 3 years or less..or you cannot denounce ur masters degree and say I am only bachelors..

From the bulletin looks like a lot of EB2 India cases should have been approved in December 2007 to hit the limit.

Also is it true that so many backlogged labors were approved since September 2007 that they hit the visa number limit. It would be interesting to get information on the priority dates of the people who were approved under the EB2 category in the FY 2008 timeframe.
I guess USCIS has already allocated large number of visa numbers in last couple of months. Two of my friends and their family got GC couple of days ago. They have PD of 01/2004 (IND) and 11/2003 (Philipinse) and filed 485 in June 07 and Jul 07 respectively.

It looks like uscis has already allocated visa number to approvable cases before date were retrogated and afte Christmas's vacation they started working agaian.

Default Was this legal????

From

http://usimmlaw.com/current_information.htm

And was this legal????

Maybe not. Section 203(e) of the Immigration and Nationality Act provides that employment based visas are to be made available "in the order in which a petition in behalf of each such immigrant is filed with the Attorney General...."

We know that the USCIS has adjudicated newer cases ahead of some older cases - some of which have been on their shelf for years. On the other hand, the "rapid" action of the USCIS has meant that some lucky applicants had their cases completed months or years earlier than otherwise might have been the case.

That means your friends got approval on their I-485 even when their priority date was not current ?

To be real "current", not the July 2007 case, I don't think that is going to happen if the rules remain the same.

Dont get me wrong coz this is a sensitive issue. If only the next person inline gets it. I have no problem with it coz they cannot keep others waiting forever if his app is having issues with namecheck or something. Coz if they dont use it, another number go down the drain.

Guys,

Discussions won't solve the issue? Only your actions will. Send the letter to the President and IV. Do your part in the effort. It will help you more than participating in or creating yet another heated discussion which will not yeield in positive results in your life.

All it takes is a pen (or printer if your handwriting is unreadable like me), pen and 41 cents stamp to make your voice heard in the White House.

Flowers to USCIS. Rally @ Capitol. Letters to the White House. IV rocks Washington DC.

correct. eb1 and eb2 row unused visas will first go to eb3 row but unused eb1 India unused visas will go to eb2 india. i dont expect in filtering of unused eb row visas to come to india though that has happened many years in the past.
I agree with qvadis' point. not wahwah's. First I don't think there's reserved quota for any country, there's only limitation for each country. I don't think "unused Eb-1 India quota goes to Eb-2 India" will happen, because there's no reserved Eb-1 India quota to start with.
Hopefully unused EB-1 quota will be used for EB-2 and/or EB-3 category at the 4th quarter. If EB-2 India still shows U and EB-3 India has cut off date, then EB-3 India is more likely to be benefited from that but not EB-2 India.
So even if EB-3 ROW is current, as long as the cut off date shows as U, that country is not going to be benefited from those unused quota at the 4th quarter.

Default So this means

that there were some people in EB2 India from the previous millennium that consumed these visa numbers. I am happy for them, though I am irritated by the ironical nature between EB2 & EB3 visa demand.

BTW; my masters degree & Indian passport are on sale in ebay. I just need to sell either then I will be better off !!!!!!!!!
