this quarter (till Mar) or unavailable for rest of fiscal year. Doesn't DOS release GC visa numbers every quarter unlike H1.

EB2 - EB3 is not decided by just your own education/experience, the job needs to have htat requirement. So if his company sponsors another LC+I_140 for another job on his behalf, and that one has lower requirements, then he can get this done in EB3.

I'm sorry to tell you this but 'unused EB1 India' do NOT automatically go to E2 India. That is absolutely incorrect. Countries not NOT have a specific allocation. They are simply subject to a cap on the maximum number of visas they may consume. For example, if Indians received only 1 greencard for the whole year, it would be a terrible injustice and wrong, but it would not be a breach of any guaranteed quotas.

Any difference between India Eb1 that were granted and the theoretical limits of India Eb1 remain available for Eb1 ROW, Eb2 ROW and EB3 ROW first (and in that order). Assuming that still doesn't exhaust what is available, some are redistributed to other oversubscribed areas. That is because they are not 'unused indian EB1' visas. They are simply EB1 visas that were not required by EB1 applicants, including Indians.

Of course, there are always abnormal things that happen which could result in EB2 India receiving some visas as the fiscal year ends, but these have nothing to with India's Eb1 'unused allocation' because there is no such allocation.

Not good news for many, but hopefully brings some clarity on the trickle down.

I have cleared all except for name check which I don't know if it has cleared or not. I guess I have to sit and wait.

I don't think having the A # means a visa is assigned. My 140/485/EAd/AP filed concurrently on Aug 17 and I got an A# on my 140/485/ead/ap applications. I doubt they would assign me a visa number without even a 140 approved. Must be just to track cases, keep cases together etc.

yes...u can consider an 'A' number to be like a file number or a person number...i think i read in one of the hundreds of uscis docs i read that they are going to be moving to a person based file number system...so all ur immigration related docs, f1, opt, ead, h1b and other alphabets and numbers in the immigration soup are associated with you.

its a sytem change rather than anything else so i doubt it will affect our As and Bs number

ROW-3, PD 01/2004, 1-485 pd 06/07, NAME CHECK CLEARED, EAD RECEIVED.

i PHONE NSC AND IO TOLD ME THAT MY CASE IN UNDER REVIEW. dOES IT MEAN THAT MY CASE WILL BE APPROVED SOON?

One more thing we should remember , As long as EB2 ROW is current, it is always good for EB2.

This all magic they have been doing, they want to stop porting dates, i am pretty much sure last quarter of 2008 , they will move the date for EB2. Since currently I-140 Processing date they moved it Apr'07 and might want to finish the backlog for I-140.

So it means they want to finish all the I-140 processing fast by this quarter, Then they will know how many is going to Port the date. Then Calculate exact numbers.

Last year also EB2 was unavailable for some time , all they have been doing back and forth to arrive exact numbers for approvals.
