As a result the annual limit for the India Employment Second preference category has been reached, and the category has become “unavailable” effective immediately.

I don't think the visa number will become available unless EB-3 ROW had become current.

This situation will not change in these coming years........only thing we can do is WAIT!

Don't even think of selling Indian passport. It's going to be a a priceless thing to have in the next 5-10 years. It's your ticket to go back to a country that can not be stopped from growing. Of course, India will have problems (many) but you know what... those problems existed while you were growing up in India and you still had a great life there.

Hope you understand what I'm trying to say here. I am tired of waiting and being treated like a beggar...

Unavailable for rest of FY08. New visa numbers will be available starting Oct 2008, but how long they will last is anybody's guess.

Eb3 Row will not become current anytime soon. Going by data, which seems to be 1% of the universe (5000 on vs 500000 Primary Applicants with USCIS), 270000 Row I-485 applications should be pending with USCIS. And Row has around 100000 numbers per year.

Which means there are only 10000 numbers / year for India for the next few years and so the PD will not cross 2001 anytime soon.

this is not necessarily the case. you need to go back and look at the Sept.2007 VB, a month after the whole fiasco when all categories were retrogressed and made unavailable. Sept. 07 VB opened with -
EB3 India was still unavailable, EB3 row was at Aug.2002 and EB2 India surged to April 2004.

EB3ROW dates need not be current for EB2 India to go from U to having a cut-off date.

My PD is EB2, Feb 2002 - India. I have been waiting for 6 long years. Should i wait or change employer using AC21? I am really confused. What are the chances of my PD becoming current this year?

I personally feel it's a royal waste of time to wait for some thing to happen in life. It's best to always take a decesion on the basis of what i can do now. Just my $0.02

I agree. Anything can happen in the 4th quarter. It is the USCIS inefficiency, which leaves many visa numbers to be used in the 4th quarter, which gives some relief to the retrogressed countries. But don't count on it to happen every year. It did not happen in FY2006 when India got 10000 numbers only.

Default but it happened in 2007

When India EB2 and EB3 got a lot more than the 10000 numbers... I don't remember but I think it was more like 70000.

That means your friends got approval on their I-485 even when their priority date was not current ?
Sorry for confusion. I got the correct information from them. It seems they got approval email when date was current but received their welcome package few weeks later when date was unavailable.
