Thumbs down NSC is not processing EB3 Even Though PD and Proc. Date is Current+NC Cleared

I just spoke to my congressperson office and was informed that NSC will not processing EB3 cases no matter if priority date is current+ processing date is current+namecheck is cleared. Right now they are emphasising on EB1 and EB2 and it could take upto one year before they get back to EB3.

Why discriminate againts EB3? Any idea if IV can launch a campaign for this?

What do you mean that it will be a year before they start processing EB3 cases, they will start it again by October when the new fiscal year starts and numbers are available again for some dates.

Year till we will see approvals for PDF 06/2005 and later. And again, NSC only moved 2 days in processing time as compared to the last month. If it stays like that, then of course it will be an year or so. You cannot even file a service request until 30 days are passed according to the procesing times.

I think they will process till the end of the month. The 'U' is for the month beginning in July.

The USCIS has a duty to process EB-3 according to the US law. The number of EB-3 issued GC should be at least 28.6% from the total number of EB GC.
Even if EB3 becomes "U" in July, they should resume EB-3 processing on October 1st.

Thats right but the response I got is they are not processing EB3 cases period, and you have to wait. If that is the case, it is really insane.

Same response I got from TSC. I asked IO what is the status of my case? IO told me that your case is EB3, first EB1 cases have to go then EB2 then they will look into EB3 cases irrespective of PD and RD.

I believe they will continue to process EB3 ROW till the end of the month as said above. Why? I just got my GC this evening. The notice is dated June 6, 2008. I am EB3, ROW, PD 12/24/2004.

congrats! I think USCIS are going to continue processing EB3 until the end of the month if you already have a visa number assigned. but if someone has no visa number assigned and as the numbers are unavailable currently, they have to wait until fresh numbers are available in Oct 2008.

NSC is still processing EB3ROW cases according to . Infact there was a large uptick these last 2 weeks in the % of ppl who got approval emails.

And perhaps the congressional staffer meant next fiscal year (which starts from Oct 1, 2008) not next year or 1 year from now. Incidentally DOS assured us in this month's VB (Visa Bulletin) that Oct VB will be like June VB.

But given the large volume of cases which NSC is now going to tackle (filed in July and August 07), a slowdown is to be expected in the next Processing Times (PT) notice. Afterall it only moved 3 days last month (Apr Notice for 485 = July 11,07 & May = July 14,07). PT is the new VB!
