When he predict that Eb2 will be current in a year.. There were lots of things going on. HR 5882. also since last two years visa dates jump... but now USCIS has 2 things (1) New IT system.. Not in production but atleast in stagging.. ( 2) Email request from AILA lawer.. Both will give them at least 50 % idea on pending cases.. and all of us know date only moves when USCIS pretend that they dont have lot pending case..

Based on current situation dates will only move till 2005 in FIScal 2009.
If new law adds new quota or recapture happens then it may becoime current. OR while recapturing they may put clause to give recapture to only who has pending 485.. Thus dates may or may not move to current but close to current.

It is still possible. I think we can depend on the CIS to drop the ball once again, as they have done every year for as far back as anyone can remember. If they do, then cutoff dates will have to be moved forward so that overseas posts can make up the difference.

When they made it move forward last year he assured that not many AOS will be approved and was right about it.

Default Nomore EB2 for Software Engineers?

Just to inform our current and future members what I have heard: There is no more EB2 category filing for software professionals beginning from the early next year. Even some big law firms now itself are not filing in EB2 for software people.

Could you be a little more specific? We already know that EB2 will jump by a couple years in the last quarter of 2009, since they are getting all spill over visas from EB1.

What is the 'big change' expected in EB3? Will they be sent home? Will they get a percentage of spill over visas from EB1?

Hi Vdlrao,

I have a EB2 Labor application in audit currently. Did the lawyer you spoke to confirm that this new policy of not giving EB2 to s/w professionals will affect existing applications or is it for new applications from next year?
