Default SPILL OVER From FAMILY CATEGORY?

The visa bulletin for September says that:

"Worldwide Employment-based preference limit: 162,704"

This is over the per annum limit of 1,40,000 by 22,704!

Is this 22,704 visa numbers coming from FAMILY QUOTA as SPILL-OVER?

I believe so!

That means the whole 22,704 will go to EB2 India/China before Aug-01-2006 - That's great. More people from the queue will get out and we all will have a better chance in future!

the new per-country limit is 27,209 so there is a greater chance that a new country was born instead of extra visas for EB guys... couldnt help it, spillovers dont have a category quota so why not throw some to EB 3 too

Default What is this 27,209?

What is the significance of 27,209 for us? It is 7% of family + EB. But with the spillover it will be much more than that for India this year.

Smile Is this why we are missing vdlrao?

I think vdlrao was pretty close on this spill over #s of 22,000+ visas. Where is he now, already one dude opened a thread for October 2008, vdlrao come out of the shell buddy.

The fact that we are getting more visa is good news. But why there is a spillover from family based in the 1st place, when people who applied more 10 yrs ago are still waiting.

The reason for SPILL OVER FROM FAMILY QUOTA is:

Unlike Employment based category 99% of the Family Quota GCs are given through US consulates across the world. In the case of Employment based category majority of the GCs are processed in US through the USCIS service centers as Adjustment of Status cases.

There is a limit in the capability of each US Consular offices to adjudicate GCs in a given month. So, it is not possible for all US Consulates to consume all the remaining numbers in the last 1 or 2 months of a year. So, Department of State calculate the potential wastage in Family category and allocates it to Employment category.

In Employment category, they could easily avoid wastage as the processing is completely done here in USCIS service centers and they could allocate most of the GCs by allocating more staff for adjudication during August and September.

In September, the dead Nebraska Service Center will wake up and probably in 2-3 weeks time they will adjudicate all possible EB2 applications (until all GCs for the year are over) in a frenzy. That is not new for them..and most probably they will do that.
