Default EB2 for india and china unavailable as of Aug 21st

Guys,

I went for a infopass today. The officer told me that on Aug 21 they ran out of visa numbers for EB2 india and china.

I know this came up earlier, in the forum, just wanted to share this info..The office did waive out a paper which he said came out 4 days ago .

An interesting piece of info he gave was that the EB2 PD dates would remain at the Sept VB level when new year starts in OCT.

DOS has to decide on that . Not USCIS/DHS.

Interesting synch between DOS and USCIS. DOS says there are more numbers available and issues the bulletin till Aug 1 2006 and USCIS says it already used up all!!!!!!! wow , I really don't understand why they issue like that in the sept vb . Mystery !! I have a couple of posts mentioning the same when they went to Infopass which I brushed it aside, now it seems to be true

I do not understand why DOS has advanced visa dates for Sept '08 by two more months for EB-2 India? This means, DOS says there are plenty visas for India / China but USCIS says no visas for India / China. I think there is reason to believe something fishy here from USCIS side unless both dept come up with proper explaination.

Thanks for info. But is there any official link which says on Sept 1st unused FB visa will be allocated in Sept? As per infopass appointment for anjans, IO said visas will be available in Oct '08.

In Sep bulletin they said 162,704 EB visas are available. 162,704 - regular 140,000 is 22,704.
2. The fiscal year 2008 limit for family-sponsored preference immigrants determined in accordance with Section 201 of the Immigration and Nationality Act (INA) is 226,000. The fiscal year 2008 limit for employment-based preference immigrants calculated under INA 201 is 162,704. Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 27,209. The dependent area limit is set at 2%, or 7,774.

Why would they want to keep accepting applications and increase their work when they have sooo many apps still pending..
doesn't make sense.. looks like they dont have a sync between 2 offices..

We don't have an option but to wait till Mid sept when new bulletin comes out for Oct..and hope they don't push the dates back too much
