The cut-off dates for the Employment Third and Third preference “Other Worker” categories were held and then retrogressed in an effort to bring demand within the average monthly usage targets and the overall annual numerical limits. Despite these efforts, the amount of demand received from Citizenship and Immigration Services Offices for adjustment of status cases with priority dates that were significantly earlier than the established cut-off dates remained extremely high. As a result, these annual limits have been reached and both categories have become “Unavailable.”

Visa availability in these categories will resume in October, the first month of the new fiscal year.


Looks like EB-3 will remain "U" till Oct 1st, 2009. The only good thing about this whole thing is that USCIS some how found and got hold of all those old cases with old PDs and are processing them now. So hopefully, the movement starting Oct 1st, if any, will only be a forward movement.

No forward movement in EB2 (I or C).

I am very confused. First they retrogress and then they make it unavailable. How could they be in the dark with regards to the number of "approvable" applications!!!

Default No more Hopes for Eb2 I/C either

With Limited visa numbers and now USCIS has improve efficiency they will process more and mroe Eb2 ROW and Eb1 application and less spill over to Eb2 India / China.

May be Eb2 india and China will clear 6 months in a given year.

2010 It may reach 2005
2011 It may reach Mid 2005
2011 It may reach 2006
2011 It may reach Mid 2006 and this continues....

This sucks.. I always thought it was those 245(i) illegals are clogging up EB3. Not sure what else is constipating the system so it barely gets past Nov 2001.

Default Let me tell you why...

EB1 spillover may never come for some time in the future. The Indian IT companies are applying under EB1 for their PMs and Senior PMs (req: BS in any discipline + 6-7 yrs exp), labeling them as multi-national executives. They are also making the employee pay for the 140 and 485 so that the financial impact is reduced a lot by a potential rejection of the 140.

This is as much BS as labor sub. I think everybody here knows how tough it is to get EB1 classification for researchers. But what scrutiny is there for these "multi-national executives" ? All they have to do is spend some time in India or any other country as a PM or SPM, come to the US on H1B and promptly apply under EB1.

Default IV core

there was a rencent drive undertaken by IV which involved getting a list from USCIS (or some other authority) about where the visa #s are being used, right ?

Perhaps something to do with collecting money from the requstor..
Basically, USCIS sent letters to a few folks asking them to pay 5000$ or so to get the list as it involved some programming ?

Where is that ? does anyone know ?

the visa bulletin is just ...what do you say....

I think those who are eligible to change to Eb2 should start immediately. In any case Eb2 was much better in past and it will be in future also as all the other country quota EB1 and Eb2 will automatically come to EB2 India and China every year. All the Eb3 should wait 10 years or hope for some law change.
