As per this poll, there are very few people left from EB3-I 2001. So PD should touch 2002 in first quarter of FY 2010.

Does anybody disagree? Is this a genuine hope from DOS?

I guess there are not many applicants with PD before you. You shud get approval pretty soon.

Remind me, how far did EB3-I dates go before retrogressing to 1998 ?

Thanks for the positive note. But based on this poll and assuming Ron's info (44000 pending EB3-I) correct, there are about 7000 people before me. It means I will get approval in 2012 (assuming 2800 per year) unless there is a law change.

This Vertical Spillover change in rule has put EB3-I in complete garbage. DOS didn't do justice for us who are also human being just like EB2

You are incorrect to assume that the vertical spill-over has hurt EB3-I.

The vertical spillover rule was EB2ROW-spillver->EB3ROW-spillover->EB2-I/C-spillover->EB3-I/C

Now the interpretation is EB2ROW-spillover->EB2-I/C-spillover->EB3ROW.
If anything, the change in spill over rule has hurt EB3ROW.

The new interpretation has not affected EB3-I at all.

The only reason EB3-I used to get a large chunk of visas (2007 and before) is because USCIS would pre-adjudicate cases in the order in which they would receive them, without regard for availability of visa numbers. Since traditionally there are a large number of applicants for EB3-I, a large number of those apps. would be pre-adjudicated, and hence approved with spill over.

Anyway, the above is how the USCIS operated a few years ago. A lot seems to have changed since then.

You are incorrect. Earlier EB2-ROW spillover was going to EB3-ROW keeping EB3-ROW as current. IF EB3-ROW is current then EB2-ROW was going to EB2-I/C and EB3-ROW spillover was going to EB3-I/C.

So EB3-I/C was at second place when it comes to spillover. Now its at last place and that doesn't work any more.

You should stop giving false information to EB3-I people. Just because you are EB2 and you will get GC pretty soon, doesn't mean everything else is all right.

Does this poll any sense with DOS backlog? There are only three people on this poll before Nov 2001 and still EB3-I dates retrogressed.

Anybody, any thoughts?

It is not a scientific poll. It never explained the movement of EB3 so far. I already told you that you are wasting your time. I saw 122 similar polls in the forum before. None worked. Sorry to say this but this is the truth.

When trying to analyze EB3 VB movement, we have to take into account 245i cases which were around 250,000 primary applicants. Most of these cases have a PD before April 2001. That is the reason EB3I pds are standstill at 2001 for the last couple of years.

There is no way we can account for 245i guys as they won't be tech-savvy and won't visit IV.

We should probably contact our lawmakers to get number of pending 245i cases in each EB category.
