Default Irresponsible Employers

When I was hired last spring, I was not told about GC retrogression by my employer. I beleive they should have explained in graphic detail and if they done so I would not have left a good job and my home in Canada to move to an American nightmare.

I recently discovered that I have at least a 5 year wait as an EB-3. My teenage daughter will be too old to get a green card as a dependent and my wife is seriously depressed about not being allowed to work.

How many other people are as P-Oed as I am and is there a class action suit here?

Sorry to hear you didnt get the correct picture before joing the American Dream. Read information on IV Home page more about retro. IV team is working on these issues and hopefully you may get the GC sooner than 5 years.

Most employers pretend as if they dont know anything about retro, whereas they have employees in their own company in that situation.
Lot of people do not know what they are gettng into, a lot of new H1b applicants go look for employers promising Green Card carrots and switch jobs only to find out at a very later stage that they are retrogressed. Same with sub labor, lot of people switch companies as they get sub labor, just to find out later they cannot apply 485 due to retrogression.

A lot of people still don't know what kind of mess they are in. I tried explaining this to a lot fo people who do not understand, and they never made an attempt to understand, thats the reason why IV still has only several thousands members where those affected by retro is in lacs.

My only advice to you is "think positive", "put a lot of effort in your skill and job", "stay put with latest news", "Help IV" and be careful with employers or lawyers or body shoppers

I'm pretty upset too after getting the same nasty surprise. Fortunately I only have about 100 miles to move to return home. I'm surprised that a major corporation like the one that hired me would be so sleazy.

They say that they will start green card process.
They cant and they dont promise how long it will take.
So its your job to do the homework. Even now i come across
people accepting job offers with lesser pay because they promised
green card processing (and have no clue about the backlog). I tried to explain him and he didnt seem to take it seriously. I guess he will (and thats
the way most do) learn it the hard way

Welcome hopelessinseattle!

I live in Seattle as well.

You are right. They do not tell you likely because employers enjoy the idea that people visa dependent many times turn out to be "more productive" for the company. This is just a nuance, but I can speak from my own experience that I used to work longer hours and demand less when I was on H1B. It is a fact.

Only time will tell. There is no lawsuit angle to be explored against this as far as I know.

It is interesting what other members reported about people being in denial, even when you clarify about the difficulties about the greencard process. I had my own brother coming here and his employer talked big about greencard, etc and he started making plans to bring his wife. I told him everything we have been through and he didn't pay attention to it. In the end it turned out that his profession was not even eligible for H visas.

If you have to put something in Hindi etc, please put an english version translated with it. Its insulting to share joke with only people who know a certain language.

Imagine this: If you are in a restaurant with a fellow Indian and an American co-worker, would you talk in Hindi, crack a joke in Hindi and then giggle? Wouldnt the other guy think that you are laughing at him?

Same thing. Please put translated english versions with whatever poems, phrases, proverbs...etc. you have.

This is absolutely the truth. I think that's why some people likened H1B to "slavery"... The only difference is probably you have choice to not come under H1B, which may even disguise H1B's true nature further.

Maybe IV can also help spread the words about the whole H1B and GC thing to people who are thinking about coming here... not exactly as rosy as some people thought. Hopefully when people know more, they will make more informed decisions.
