You can apply and if you want to file for your daughters, then they will have to be present here at the time of filing.

Default Kindda Unfair...

Good news for some and not so good news for others. I have been waiting for my labor for last 4 years and have still not got the approval on hand. So I am not ready to apply for 485. Where as a friend of mine who came to US last year and applied for labor through perm 2 months back has his approved labor and can apply for 485. I feel this is kind of unfair. The dates should have progressed slowly but steadily instead of trying to create a mad rush now.

I had a similar issue.. labor was stuck in the backlog ctr for 4 years.. Tired of waiting - i then directed my lawers to request the dol for a screenshot, ven though my h-1b was valid and i did not actually need it.. lo and behold.. 15 days after that .. it was miraclously approved.. I suggest you try the same.. keep me posted if that works.

Hello All:

It is great that the dates have become current and many of our friends here at IV can apply for 485. Congratualtions!!! to all that can apply.

I am in a dilemma and donít know what to do:

My LC has been approved PR 02/10/05
My I-140 is pending.

I know I can file for 485 but my wife is on F1 Ė OPT and is working she has applied for a H1 and will get it because of Masterís quota but will not be effective till October, 2007. Can I file 485 now even though she is on F1?

I have two choices, either wait till October 2007 or cancel the H1 go to Mexico and get a H4 stamp for my wife and apply for 485. Please advise what I should do. Thanks!!!

My I-140 is approved and already filed I-485. Finger Printing completed twice and Medical also completed. My PD is Sept 2005 filed at Texas. Texas Processing completed for I-485 shows Sept.2006. This means my processing is completed and now the PD is current can I expect the Green Cards ....

This is certainly good news for many. However the skeptic in me is feeling very uneasy. Why did they suddenly open the flood gates? Did they purposely create a backlog and then increase the fees (double the fees) just in time? Are we going to face other issues down the line after applying for 485?

I guess for now, we will just celebrate and try to get our 485 applications in before July 31st. After that it is a wait and watch situation.

Congratulations to all who got through this first hurdle.

Default Filing 485 ( wife on H1B)

Hi folks,

My labor and 140 got approved and PD is march 05.
After the good news, I can apply for 485, But I have
a question. My wife she came on H4 here and then converted
to H1B and get stamped also. Is it going to be a problem if I apply 485 for
her ( because of H1B) and if its not a problem guide me what are the necessary documents
for her.

Please check with your lawyer but as per my understanding, your wife needs to be in 'status' to be added as a dependent on the 485. She doesn't have to get on an H4 to be added as a dependent. Since she is on F1, she is already in 'status'.

If you overanalyze any situation, for the matter even, "why come to work?", one will always find consipiracy ..

I say lets not overanalyze this and lets celebrate and keep our fingers crossed for avoiding any further issues !!..

Default why didn't you start a Parallel PERM app ?

Look, i sympathize with you but you SHOULD HAVE poured in some money to start a parallel PERM application ..... PERM started from APR 2005 - you got almost 2 years +

My case is also like you but my Labor was 2 years old and applied just
before PERM and it went straightway to Phily Backlog center ... I thought
of applying for a Parallel PERM but mine was a RIR ( quicker) and Phily was saying that they would clear all Backog by SEP 2007 ( another 2 months)

Did you check your status in Backlog tracker ??
