Question Date mismatch, passport and birth certificate. What are my options?

Birth certificate of my wife shows a DOB that does not match with the DOB on her passport. Basically it all started with her school registration process. Now we have a situation where all her documents and certificates have one DOB and her birth certificate has other.

I searched for information on various boards, but no one seems to have any real answer. Is any one else in the same boat?

I can get an affidavit done from her parents. But should it be attached with the original birth certificate? I have heard about cases where "only" affidavit submissions are rejected. They ask for supporting document like "non availability certificate". There is no way that we can get the non availability certificate since her birth is registered!!!!

Does any one know what can be done here???

First of all they may not reject your application without the non-availability cert. If they do get back to you with an RFE, then you can show the school-leaving cert or PAN card if you have one. I would not send the birth certificate at this stage at all. I know of cases where the affidavits alone were sufficient.

With a birth cert available, the municipal corpn in India will not issue a non-availability cert, and trying to get the date changed on the birth cert will require a civil court case. You know how long that can take in India --- years!!

Default sounds complicated

It looks like you have a "legal" birth date on all documents including US visa and all others which is different from the real DOB.

You can still get affidavits from ur relatives and parents attesting to the legal birth date. You can submit school records as evidence for this legal birth date.

Default school leaving in regional language

Another problem: School leaving(supporting doc for parents affidavit) is in regional language(marathi). Any idea what can be done here???
