Default I140 approved - 3 yr extension or 1 yr?

Hi,

I have a PERM approval in EB2 with PD Sept 2005, and I140 approval few days back. I will be entering my sixth year in H1 shortly, wanted an advice whether to go for 3 year extension or 1 year extension, are there any demerits of 3 year extension with respect to H1 transfer in case of layoff, etc?

No difference. You pay more for 1 yr textensions as you have to do 3 times as compared to 3yr extension. No lawyer will advise you to go for 1 yr if you have an approved I140....

Default When you can get 3 years, Why you want One Year

Last DEC I applied for my H1 for 3 Yaers, and it got approved.

My I -140 approved long Back, waiting to see my PD current.485 applied in 2003.

Are there any risks of going for visa stamping with a 3 year H-1B after the approval of I-140.

If your I-140 gets approved when you are already in the sixth year, can you still seek the 3 year extension?
