Folks,
I read the following from immi-law website's breaking news:

10/26/2006: BEC Traditional Labor Certification Processing Time to Remain April 2001 for Sometime to Come

AILA has reported that the BECs are still processing April 2001 traditional cases for the traditional case track and it is not expected to move ahead for sometime due to the huge number of 245(i) cases which were filed in April 2001.

Looks like people who are stuck with their TR shud consider converting it to RIR.

Default PD July 02/EB3/RIR

One of my colleque, same company, same job category his labor got cleared yesterday, he filed 4 months later than mine. He is preparing to file I140 and 485 both concurrently. The difference here is his labor was filed in EB2 and it went to Phily BEC. I have 4 years more experiene than him. Since our's is a huge american company, my case went to different lawer in the same law firm and that dump a** screwed my life by filing in EB3 even after I asked him to file in EB2.

Dear my friends Can I get copy of LC filing copy and 45 letter copy through
FOIA? I recently got laid off after working 4 years in same company. My employer is refusing to give LC filing copy. In my knowledge to get new H1 as I am 8th year extension from my new employer, I need to have copy of LC filing. I am in dilemma; please guide me if you can. I will really appreciate any guidance from 1V members.

Ask your new company attorney to send a request to BEC for the case status. And ask your ex-employer not to withdraw the case from BEC at least. They owe you that favor for the work done in past four years. Or you can send an e-mail yourself to BEC.

Check this on Backlog center web site ...

H-1B Visa Extensions

DOL has worked with CIS to set up a new system in the Backlog Elimination Centers to assist individuals who have submitted an application for permanent labor certification prior to March 28, 2005 and need proof of the submission to apply for an extension of an H-1B visa.

Individuals should send an e-mail to the appropriate Backlog Center explaining the need for the H-1B extension and requesting verification that their application is pending at the Center. The email addresses are h1b7yr@dal.dflc.us for the Dallas Center and h1b7yr@phi.dflc.us for the Philadelphia Center. Include in this request all pertinent information (employer name and address, alien name and address, date of filing, state where filed, case number, if known).

The Backlog Center will respond to the individual with verification that the application has been pending for 365 days.

Thumbs up Dallas BPC Labor Approval

My LC was approved from Dallas BPC few months back without any communication from DOL and NO 45 day letter. One fine day my lawyer got the approval in post.

I have no clue what is the method of processing cases (suppose to be FIFO).

My PD is March 05, EB2 ...

You will lose your RIR automatically when you apply for PERM with same company and same job description. If everything is same, they should in theory retain your old PD but it is not guaranteed. So, there is some risk associated with this process. Alternatively, you can continue to wait for a few more months for your RIR to come through. BECs have been chruning our RIRs at a fairly decent rate. They have an oct 2007 deadline to meet with all BEC cases.

The below comment is not true. Please consult an attorney for your specific case. It is possible to have a PERM application, even though your RIR is pending in BPC.

My lawyer is telling me my labor got approved on Dec 13th but it is under reviewd! ( EB2/RIR/OCT 04/CA) however my case shows In Process when I check it. can some body explains what does it mean please? Thanks
