The cenetr does not provide any information to the employees, your attorney or your employer can call the center and get updates on the case.

Thanks for the response, Widget. Worked with HR to ensure that the lawyer's office has sent the reply via Fedex overnight today, and I have the tracking number for it. So, should be OK this time.

Just goes to show how dangerous it can get if they implement the proposal that "limits validity of the certified permanent employment applications to 45 days 'from the date of certification' under proposed substitution elimination rule"!

Well, my attorney is pretty bad, but I've finally be able to weazle some info out of her.

No 45 day letter

According to info from my attorney "All labor certificates have been sent to backlog centers; we will know which center your application has been sent to by June 1"

I'm assuming that it is actually at Dallas though.

Franklin,

You do not have to assume. Your case should already be with the Dallas BEC. When your lawyer says she does not know which BEC your case was sent to, she is either not being forthright with you or is completely uninformed.

Default Backlogged case Vs PERM

My Labor (EB2) was pending through my first employer (Fortune 100 company)...since Jul 2001 and till date no answer...last I heard was it was at the Dallas Backlog processing center...

And then the news came from the employer...lay off....5 years of waiting...all down the drain...

Anyways, picked up the pieces found another job, lawyer filed LC through PERM in Feb 06, just got the labor yesterday Apr 06 in 55 days flat....

Now moving onto I-140...

To be honest, I have lost complete faith in the US immigration system...a country that treats its cream immigrant population so badly, doesn't deserve us...

Thanks for the confirmation, Arihant. I've long suspected that my lawyer is incompentant, and have voiced this frustration to the HR dept at my company. I contacted her back when she told me she didn't know which BPC my case was at and she said:-

"Actually, the State of California was split between Dallas and Philadelphia"

This contradicts everything I've read about it.

I'm new to IV (and other similar forums) and joined up specifically to find out more info about the process since I was concerned about the lack or accuracy of the information that I was being told. Seems like my concern was not misplaced.

I feel sorry for you dude....but atleast you were able to find another employer! If you were beyond 6 years of H1 that would have been impossible!

Thanks for the posting. I have seen little info on cases from Michigan. My status is as follows:

PD - April 2001
EB2, Non-IRI, Traditional.
April 2004. Michigan Dep Career Dev rejected application.
July 2004. Employer appealed.
Dec 28, 2004. Case moved to DBEC
45-day letter ?

Default Question for the pros

I am under the impression that one's 7th year H1 is contingent upon his GC being filed by the end of the 6th year. If one's GC application is revoked (by applying for a new GC), wouldn't that invalidate the 7th year H1 too? I could be absolutely wrong here, but this is my understanding.....could some fellow IVer please explain if I am correct?

Hi,

My case: EB2/Non-RIR/CA/PD March 2002, not received the 45 day letter.

I am in the 8th year of H1 so I am unable to change employers within the US. My employer is taking full advantage of this situation
