Default Labor at Dallas BEC

Guys -

This is my first time posting here. I have been reading different people's experiences about their labor approval.

Here's my story:

Filed for labor in Dec'03 from Wisconsin under EB3. Was approved and sent to Chicago in August 2004. Since then, not a word. Have not yet received the 45 day letter. Is this normal? I am starting to panic a little bit, though I know there is not much I can do in this case.

My attorney is not the pro-active kind. She is just twiddling her thumbs waiting for an answer from USCIS.

Should I call myself and follow up on my case. Can I say this is the attorney calling as opposed to saying this is the alien calling??

Folks -

What is the form ETA 750B?

I filed for my labor in Dec'03 from Wisconsin under EB3. In dec 05 my attorney sent me the form 750B asking for my signature. That is 2 years later. Is this the form the attorney should have submitted when initially filing the labor certification?

I am still awaiting my 45 day letter.

Default Time for LC under PERM

Hi,
Just a curious question. Is there a difference between LC approval for EB2 , EB3 applications under PERM?
What I mean is, is the processing times different for applications filed under EB2 and EB3?

My application was filed along with few other employees who are in EB3.They have received their approval within 2 weeks and mine is still pending. Does anyone know the reason behind this?

Default 45 Day Letter By June 06???

Hi, I just found this website and it's EXCELLENT! My PD is May 2004, RIR, Texas, still no 45 day letter and I'm on my 6th year of H1 visa. My lawyer has no idea when I will get the 45 day letter (can't blame him though). But I did hear from someone that for all those whose PD is 2004, 45 day letter should arrive by June 2006, and for PD in 2005, 45 day letter should arrive by Oct 2006. Did anyone else hear this too, is there any truth to it??

Default I encourage your enthusiasm, but think beyond the bun.

I mean, think beyond LCs. See what is coming and how long it will take after LC and 140. Once again, keep the hopes high and your anticipation of 45 day letter will not happen. I am sure you may have seen this post in this thread.

Hi,

new to this forum..need some help!

My LC was filed as PD 11/2003, Regular from MI.
I am still waiting for an update from BEC. I wish to know if there are regular applications getting processed and approved from dallas BEC.

Does it make sense at this time to continue on with my application or start a new PERM process? Are there any risks involved in the regular LC?

Dat is not good...Do you have any proof that they filed for you in Dec'03???
Otherwise it is possible that they scr*** you royally.....Most likely your PD is dec 05 now. It happned to me also I asked my company for file for me...They kept telling me that they have filed for 1.5 years...One fine day they told me that the DOL can no longer find my application.......Lawyer said she submitted the application and she dunno what happened...
Looks like your case is just like mine....
Your PD is Dec 05 now...unless you have some proof of the 2003 filing.....

If you know your approx filing date you can ask DOL for the H1B 7 th year extension proof...If they have your application they are most likely to respond in a few days...For more information on how to send that request please go to the DOL.gov website and look around a bit....

If they respond then you would get the case number ...Donot ask for the same multiple times just once .....

I already have a case number D-05192-XXXXX. Does the case number mean only that my application is pending with dallas bec? or does it tell anything about processing time/status?

Your case is with Dallas and was entered int the system on 192 day of 2005
