Everything is being processed in a chaotic fashion. FIFO is not being followed.
The approval itself has gone well into 2005 priority dates. I am suffering too without even a 45 day letter (Feb 2004 PD).

Hello eagerr2i,

Do you know how this process is actually handled? I am currently at the same stage, waiting to hear from DBEC regarding my non RIR case. Do you know if the company has to conduct a full blown recruitment? If so, does this mean that the case has a change of being on hold or rejected based on the results of the recruitment? How long is the recruitment process?

My labor was applied from MI State, 2003, EB3 RIR.
Till now I have not even received the 45 day letter yet.
Anyone has received 45 day letter recently for labor filed from MI State?

Progress Update from the DOL Backlog Elimination Centers

The Department of Labor recently announced important information regarding the progress of the two backlog elimination centers in Dallas, TX, and Philadelphia, PA. According to numbers released to members of the American Immigration Lawyers Association in late March 2006, the DOL is almost halfway through reviewing its inventory of over 300,000 labor certification applications. Their current goals are to have all Center Receipt Notification Letters (also known as “45-day letters”) issued by the end of June 2006, and to have the entire backlog inventory cleared by the end of September 2007. In order to achieve this goal, it is anticipated that the rate of certification will increase over the remaining 17 months.

The CIS receipt notice is referred to as a “45-day letter” because the beneficiary/applicant has 45 days within which to respond to the letter or the case will be closed. The 45-day letters are sent in order to adjudicate both traditional labor certifications and Reduction in Recruitment (RIR) applications. The 45-day letters are sent to employers to check the existence of the company and also to ensure that the employer wants the case to move forward.

One project of particular interest is the possible creation of a “queue” of cases once all 45-day letters have been issued and responses have been received. The creation of an organized queue would allow the centers to post processing times, which would be an invaluable tool to employers, employees, and their attorneys. With this new potential process, more definitive measures can be taken by employers in making plans with regards to their permanent residency cases.

Traditional non-RIR is my belief.
State: CA
Received 45 day letter: 5/1/2006.

Awaiting LC.

Hearing people are getting LCs from 1 month to 8 months after 45 day letter.

I hope what you observed "getting LCs from 1 month to 8 months after replying the 45-day letter" holds true. From my observation, there's really not a time table to follow.

My PD is May 2004 and I recieved the 45 day letter today.

Any idea how long from now before LC is completed?

How long are others taking? I am hearing generally 2-8 months.

Good luck..there is not really any guess possible ..I have seen many cases which took nearly 6-8 months after replying 45 days letter , but by and large if you are lucky , you might even get your labor certified within one month after replying 45 day letter ...as it happened with my case.

Yes, by receiveng the letter at least I know that my case was not lost during the trasnfer from SWA to Dallas BEC. My lawer said that DOL told them that they do not have a system in place yet to check the case status. They do not anticipate that they will have a system in place until they are able to issue 45-day letters on all applications, which they anticipate will be by the end of June 2006. Even at that point, we do not know how quickly they will be able to implement a system to provide information on processing times. My lawer also said that they will notify me as soon as they receive any additional correspondence from the Department of Labor regarding my case.

Bottom line my manager still do not have to do anything, becuse he does not have any instructions. Long, long time of waiting ahead ;-(

My employer recived 45 days letter today by mail for dellas center. my PD is Dec 2004. i alread approved perm case and I-140. so what should i do now.
