Mine has a priority date of October 2002.
Got the 45-day letter last January (2005) and responded - It's been 15 months since......and NOTHING.

Maybe it would be eating and sleeping... if they get bored with that they might approve 1 or 2 cases.

My PD is June 2001. I believe my attorney replied to the 45-day letter in Sep 05. Nothing has happened after that. The wait continues..

He would have brought DOL work culture to your work place, who knows you might have incurred loss :-)

I have analyzed the tracker from Rajiv Khanna's site. Here are some inputs.


Cases transferred from federal offices :
There is no set trend in processing of these cases. There are a substantial number of approvals.

Cases transferred from SWA offices :
There is clear trend here. The last 3/4 months PBEC has sent out approvals from mid 2002. There are a number of PD June 2002 approvals and some PD July, august, september '02. There is an effort to push mid 2002 cases in PBEC.
The folks left over from 2001 may receive NOF or some query. I am not sure.
If you are a SWA cases from 2001 you should be talking to someone...your lawyer...employer...

Default Could this be possilbe?

Sent an email to PBEC a month ago asking about my case status. Got their response today. They assigned me a case number, which seems to be generated on the 157th day of 2005 (P-05157-54869 ). However, my lawyer hasn't received any 45-day letter. Can this be possible?

My PD is April 2004. Filed from Delaware. Anybody knows a similar case?

Below is the email reply from PBEC:

Dear Requestor:

The subject case P-05157-54869 has been received by the Philadelphia Backlog Elimination Center and is currently awaiting further review by a Backlog Elimination Center analyst. Due to the large volume of LC Applications currently being processed by the Backlog Elimination Center; we are unable to provide you with an exact processing time. If you need additional information, please visit the following Internet website:

http://www.foreignlaborcert.doleta.gov/

There is no need to submit multiple requests. If you have not already received one, the next notices that you will receive from this office will be a 45-Day Letter and a Selection of Continuation Option letter.

Why do you say 2001 folks would get NOF? Im a 2001 Aug but non-rir. Got my 45 DL in Dec 05 but nothing after that. My case was a SWA xfr. Does your analysis only apply to RIR?

There seems to be no trend. Mine is non-RIR from 2001 November, transferred from Federal. I have not heard anything after receving 45-day letter in May 2005. Recent case status from BEC says my application is awaiting further review by a BEC analyst. One day, it might be approved. Incidentally DOL web site says still 17 months remaining for backlog removal. We should see light at the end of tunnel after another 1 1/2 years.

In suport of the view they are totally chaotic: RIR here, priority date is in April 2002, 45-day letter was received & replied to in February 2005 (15+ months ago), heard nothing from them since then. Lawyer started process for 7th year extension.

Typically they send replies after a month or so. So please be patient and give a month or two. Then you should see some info regarding case status.

Default Queries regarding the Labour petition

PD : Sep 2002 (RIR)
45 Day letter: Dec 2004 (After that no news)

I had 2 queries when the case was pending with the state labour office before being shipped to BEC.
The issues were related to low wages and insufficient experience. The company fixed the issues and ammended the Labour petition.

Will that cause a problem when it comes to the approval stage? Again, will that negatively affect I-140?

My company HR received a letter from PBEC questioning the existence of our company. This is another step in the bureaucratic ladder of PBEC. First the 45-day letter to signal the intent to continue the petition, then proof of company. I wonder how PBEC thinks the LCA made it all the way to federal without anybody verifying the employer details. HR manager sent the company charter to PBEC to prove the company exists. So the wait goes on ...
