Default Age out - Suggestions

I have a son who will age out next year . I have filed my GC in EB2 and I-140 has been approved but could not file the I-485 due to retrogression. Please let me know my options. Any suggestions / advice is highly welcome.

Couple of things

1. Convince any good member of Congress to put amendment to proposed CIR/STRIVE to address age out issue

2. Ask your son to find US citizen girl for marriage

Default You both are ok

As per my knowledge, in a case you have I-140 approval before your dependent turns 21 years of age, you both are fine...your dependent age is locked.

I am in the same situation. What I am planning on doing is have my son convert to F-1 visa and begin his own journey into retrogression with subsequent OPT and H1B.
On the other hand I hope that something will get passed soon by Congress that will enable me file 485 before July 2008 when my son turns 21.

If you are able to file 485 before your son reaches 21 you should be okay. Otherwise you may have to let him go on F-1 visa.

My I-140 is approved and my son is just 6 years but I think I will have the same problem of age out if I could not file my I-485 till my son turns 21.

We at www.expatsvoice.or have writtenour own amendment to cspa as this is badly written and needs a leglislative fix. This has been sent to Congressman Dave Weldon office in Florida and since forwarded onto their Washington office. We are still awaiting news if they are prepared to help us

I do urge you contact Terry Mulford at Dave Weldons office to support

The act does not protect all children from aging out and not being interpreted expasnively even though this phrase is in writing in the act

Hi

I have filed a complaint (law suit) against attorney general, Jeff Gorsky of the advisory opinions department and others

They have come back and agree 90% of my complaint so have to prove the other 10%

Will update when I get any more news
