Default DOL Update on BEC Backlogs

This from Matt Oh's site http://www.immigration-law.com/Canada.html

DOL has reported the following blood boiling statistics to AILA:

Backlog Cases:
Total Received: 363,000+
Total Completed: 108,000+
Total Certified: 50,000
Balance: 255,000
Full data entry will will be completed by 06/30/2006 as scheduled.


PERM:
Total Received: 80,272
Certified: 36,587
Denied: 23,305
Audit: 24,960
Withdrawn: 1,950

What do they mean by completed? Completed data entry? If so, how will they complete so many in just a couple of months?

I haven't verfied this but I took "Completed" to mean that a decision has been rendered.

which states that the backlog will be cleared by 9/30/2007, I just hope this time they stick to their word

They have had this up for over a month now. Initially, they made a mistake in their math. In March, over a span of three days they changed it from 18 months to 17 months to 19 months. It was this way until around the first of april when they changed it to 18 months. I do not see any substance behind this bold claim. DOL has so far not clarified this claim. Besides, it is not like they have been timely in the past, either. So, we are not putting much weight to this claim at this point.

I think those 58,000 may be denial as well as cases withdrawn by the employers.

but look at the denial/Audit rate under PERM. Looks like they are hardly approving 40% cases

PERM:
Total Received: 80,272

the perm nos may be misleading. They have had problems with their algorithm as well as other technical gliches. Many of the denied cases may have been reapplied and subsequently been approved. We don't know that.

A couple possibilities:

(a) after the tech wreck a lot of foreign workers were also laid off -- so that their employers probably didn't reply to 45 day letters. Not replying to a 45 day letter would go into the "completed" category.

(b) If they got to the 245(i) cases, it is possible that a lot of them didn't stand up to scrutiny.

There is one more way: if you in US for 5 or more years, you can re-fill your EB3 towards EB2 as having 5+ years American expirience, but huge MINUS is that you will loose your priority date

Not so easy. If you are in US for 5 or more years you are probably on 1 year H1B extensions. Filing PERM will cancel labor (if same employer). Then you cannot renew H1B because labor must have been outstanding for more than 1 year. The only way is to concurrent file a PERM with a new employer and switch only after approved. And yes, then you loose the priority date.
