Default Offer State - Is possible to determing EB2 eligibility?

Hello,

I have EB3 I485 pending with a priority date of Aug 2006.

Now, a I have an offer from a bigger company who have verbally mentioned about restarting my GC and attempting for EB2.

However, they will not put anything to this effect in the formal offer letter. They say it's against their legal policies.

Also, is it possible for an employer/their attorney to determine if I have a good shot at EB2 upfront?

Yes, it is possible for their attorney to determine if you have a good shot at EB-2.

However, you should get your own attorney's view on this. If there is one thing I have learnt about the system it is to trust your own attorney - your employer's attorney is not acting in your best interests.

You should be able to get a consultation with your own immigration attorney for a couple of hundred bucks.
