Default Guidance to file I-485

My company lawyer has filed for my I-140. But he didn't file my I-485 due to the revised visa bulletin. But reading all the different forums, it is being advised to file i-485 before july end. Is it possible to file 485 without I-140 receipt.(My lawyer says that it will take 2-3 weeks to get the receipt). And I don't want to pay him $2000 dollars. All my other documents are ready. Please help

Yes it is easy to file I-485 on your own but if you get a RFE then you have a problem so it is advisable to file the application through a lawyer.

thanks for replying.I understand that..but how can I apply without I-140 recepit ? My lawyer could have applied online and gotten recepit in 2 days..but he says he did it by mail..thus 2-3 weeks lead time..what are my options..now this is not even concurrent filing.

I am not sure about it, maybe you could call them and get the case number, then check it online and print out the notice.

Good luck

Did you pay by your personal cheque or was it from your employer because when the service center cashes the cheque your case number will be on the back of the cheque which you can see by going online to your account and there will be an image of your cheque.

I paid my company cash.they made a cheque on their behalf I guess...now I have no way of knowing the recepit number...should I file without I-140 ? maybe USCIS will relate my 485 with my 140 by the A#....

Consult a good immigration attorney some lawyers do not charge for consulting if you are willing to hire them, now that the July madness is over the lawyers may have some time for you.

Default I485 Filed Without I140 receipt

Sunty,

I was in a similar boat as you when i filed my I485. I was forced to file 140 premium by itself as they stopped accepting starting july 2 07. So we shipped 140 on 29th june 07.On 5th july 07 my attorney shipped 485 with a FedEx acknowledgement of 140 doc acceptance and entire photo copy set of 140 documents.
