best option to get the green card
I was a resident physician on the H1B visa for 3 years. Prior to completing residency, I got the EAD(my husband , a pharmacist had applied for a Green card through his employers). That was in 2008 and we have since made no progress as the EB3 numbers are not current.
I did not renew my H1B after the initial 3 years because I could work with the EAD.
I was wondering what the pros and cons are of starting my own Green card application process. Can both of us have seperate applications without one affecting the other? Will I need to go back on the H1B?
If I have a wlling employer/sponsor, will I possibly obtain the Green Card faster than my husband since EB2 numbers are current?
Are we better of just waiting?
Go for EB2
I am assuming that you are not from India or China. I recommend starting the EB2 as soon as possible - you may be able to get green card in 1-1.5 years. It will be faster than EB3 PD of 2008.
You can start the GC even if you are on EAD and are listed as dependent in your husband's I485 application.
