Default Do we have to disclose...

My cousin's firm is sponsoring me for future based GC. Do I have to disclose this relationship to USCIS during any part of the GC processing?

This needs to be disclosed to DOL while filing PERM.

You need to answer "Yes" to the question "Is there a familial relationship between the owners, stockholders, partner, corporate officers, incorporators of the petitioner and the beneficiary?"

Thanks for the replies. So if i say "yes", would my application receive extra scrutiny? And if i say "no", how is USCIS going to find out about my cousin relationship?

When you fill a legal form, attest to its accuracy and sign your name, there are 3 things at stake:

1. your personal honor (to me - the biggest factor)

2. the fact that the firm can be blacklisted as someone pointed out.

3. As far as i know.....its a perjury to lie on a federal govt application form - please do confirm from your attorney.

And if i say "no", how is USCIS going to find out about my cousin relationship? - this should not even be an option based on above reasons.......

since "no" is not an option - whether "yes" invites extra scrutiny or not should be a moot point.

I have absoultely no intention of misrepresenting on my forms - i was merely curious as to how USCIS will figure out who my relatives are.

Also, I dont think its a moot point if USCIS is going to perform extra scrutiny or not. If USCIS typically does reject labor certs from companies that hire their relatives, then its probably not worth going thru the expense/hassle of filing a PERM app.

Google for the term 8cfr213a.2 .In immigration terms a relative means

"Relative means a husband, wife, father,
mother, child, adult son, adult
daughter, brother, or sister."

This is the law and not my interpretation. In general every human being is related to another by evolution . So you are just fine.

Default I don' think you have to...

As long as the owner is not your family member (sibling etc.,) you should be fine not mentioning it.

If its a distant (not immediate) relation, Just leave it. You will invite more trouble by explicitly mentioning it...I would not do that.

what form is that? I have been trying to look at PERM forms but cannot find the one that asks for that specific question.

"Is the employer a closely held corporation, partnership, or sole proprietorship in which the alien has an ownership interest, or is there a familial relationship between the owners, stockholders, partners, corporate officers, incorporators, and the alien?"
