Default July I 140 filer - RFE - Is it the end?

Folks please help me understand what it means.

Yesterday, I recieved an email mentioning an RFE was sent and the case is in suspended state. I have no clue what is requested. However let me give a brief background about myself.

Labour and I 140 was filed in July 2007 for a future employment (substitution)

Filed I 485 in Aug 2007. Still 40 days more to go for completing 180 days.

Jan 8 - Got an RFE (no idea what it is requested still)

Now my questions are
  • what are the situations and chances of an I-140 getting declined. Will there be a notice mentioning if it is being declined like NOID or some thing before hand.
  • I have another one of my previous I-140 which is still pending. Can I port the 485 to the this previous I-140. Can I do this before anwering the RFE?
  • My intentions are not to have chances of getting my 485 denied because of the underlying I-140 being declined. atleast I wish to make the other I-140 as basis for my 485.
  • Is there any need that I should join as an employee of this sponsoring company to brighten the chances of the evidence being accepted for the RFE.
  • In the given situation what is the best way to go about so as to retain the pending 485( assuming that the I140 in question gets rejected) like porting to other pending I 140? Can I do that when the RFE is pending?

Appreciate suggestions.

This is more likely RFE so no need to worry just yet. A lot of folks are getting RFE. I-140 won't be denied without RFE so wait until you get it, you will have more understanding about the situation.
You can port to another I-140, but it has to be approved. It may be possible to port to a pending RFE, I am not sure. You can port while RFE/I-140/I-485 is pending.

Hey Ras,

No need to panic yet. I140 RFEs are increasing lately. Ability to pay and education+experience are two major areas of scrutiny. Mismatch with substituted labor can be another area of concern in your case. Most of the folks get approvals after replying to RFEs. So hang in there.
