Default social security and H4

My spouse first came to the US on J-1 visa. She returned to her home country for 2 years and now is back in the US on H4 visa. We married during the 2 year period she was at home country. She has a SSN but her last name has changed now. She went to SSN office today and they told her that they could not update her social security card because she did not have an EAD card. She cannot work on H4 but needs SSN do get driver's license. What should we do? We live in Indiana? Anyone knows or was she unlucky and she ran into some incompetent employee at the SSN office.

You do not need a SS# for a drivers licence in Indiana. My son is one such case. You have to present all immigration documents at the BMV and they will take copies and they will have to be verified centrally before a licence can be issued. It might take about six weeks but it is possible. If you want to send me a private message with your contact details I will be happy to help since we have been living this nightmare for some time now.

indianabacklog: Thanks for the quick reply!

What I do not get is why immigration verification is needed for updating name on social security card. All she has to do is prove her identity and (old indiana ID card), marriage certificate and new passport. That makes sense to me, the social security office has nothing to do with immigration status.

Would she be eligible for a tax id other than SSN? I noticed on Indiana's website that she can get a letter from SS office that she's not eligible for SSN and she can get DL but because she already has a number that doesn't make sense to me.

To say the least there are many issues here. It is feasible for your wife to get a tax ID # but that is not going to help get a driving licence.

So much does not make sense and of course she does have a ss#. However, I cannot find the letter you refer to at this moment both my husband and son got one. Its wording is to the effect that you are not eligible for employment so you cannot be issued a number. It is a very simple letter and is issued directly while you are in the office no checking is done except of your immigration documents. For the purpose of getting a driving licence it is worth a trip to the ss office and getting one.

Once you have a driving licence it gives you time to start working on the social security number issue by first calling their customer service and asking someone there.

Just my input.

Not all BMV's are equal incidentally. If you have issues always ask for the supervisor and go from there. Carmel and Fishers are not too bad. I have had the privilege of dealing with both and finding myself knowing way more than they do.
