Default Demand Data

They have still not released the Demand Data for the Jul bulletin... The only other time I rememebr when the bulletin was released before demand date (since they started publishuing the demand), they released the demand data the next day!!

So what could have happened here?

They Forgot?
They could stopped publishing the Demand Data?? (Hope Not)
They are still working out the numbers based on actual Jun Approvals?

Should we be worried about this or am I just being skeptical and reading/think too much about it?

Certified-expired are not expired. They are certified and needs to be counted. They will be changed to certified-expired after 6 months or so i guess.

You are right, Certified expired are not expired.

As per my understanding, once the labor is approved, you have to apply for 140 before it expires, that is what expired means.....

EB2-75% and EB3-25% of total PERM approvals for each month for India and China respectively. I am attaching the spreadsheet. It can be easily modified to toggle including expired and excluding expired.

My guess is that Certified-Expired are cases which went into Audit but eventually got approved. They should be considered when counting the total number of cases.

AFAIK every labor moves from Certified to Certified-Expired after 6 months, believe that there is a 6 months time frame to file I140 after labor. Maybe they change the status so that old cases are not picked up in online inquiries etc but both these statuses are good. Someone had asked what is the EB2 I/C backlog, easily post Jul 2007 itís around 80K till date, this will be the approximate figure that will come after the labor data analysis. 2007 and 2008 have huge demand while 2009, 2010 and 2011 maybe relatively light.

All the perm cases get expired after 180 days regardless of 140 being filed based on that or not. So in your estimates you have to include Certified-Expired.

Although out of Total Certified-Expired cases some cases may not have filed I-140 so there is no way you can find out if I-140 was filed for the case or it lapsed.

@abybaby81.. I think you are breaking down the numbers based on the "Decision Date" i.e. the date the DOL made a decision on the application. You need to break them down by "Priority Date" so that we can guesstimate the demand data past Aug 2007. Check out Teddy's post a few pages ago that talks about extracting the Priority Date from the Case Number. My calculations are based on the PD and I've also filtered out PWMB cases.

These are the steps I followed:

1. Filter out cases that are NOT "Certified" or "Certified-Expired"
2. Filter out cases that are NOT "India" or "China"
3. Filter out cases with Decision Date before Aug 17th 2007 (last day to file I-485) -- any PERM approvals received after this date would have definitly not filed I-485s
4. Extract PD from Case Number
5. Sort data by PD
6. Filter out cases with PD before Aug 17th - these are the PWMB cases and can be multiplied by the Dependent multiplier (2.2) and then split up 75/25 for EB2/EB3 and then added to the current demand data to get a decent count of what the demand will be in the next few months.
7. Now the cases I have left are cases with PD's between Aug 17th, 2007 - Dec 31st, 2010 who have not filed I-485's and I can now break them down by month and multiply by the dependent multiplier and split them up 75/25 to get an approx. count of demand past Aug 2007.

There are a few assumptions here: All PERM approvals will translate to an approved I-140 (not always the case) and PERM data is for EB2/EB3 only (not the case, since my guess is that there may be some other visa categories that may need a LC too ...EB4/EB5?) and also some PERM filings will be for interfiling and they will port their dates during I-140 stage. Also there will be people who have multiple PERM filings. All of these cannot be guessed from the PERM data, so the calculation will have some variance from the actual numbers.

Let me know if anyone sees any mistakes in my calculation.

I am doing this sort of analysis for the first time. I have simply added the Certified & Certified Expired data for India and China for Fiscal Years 2007-2010. Then I have applied the 75/25 allocation to obtain EB2 and EB3 demand. How do I apply the 2.25 multiplier that Teddy K mentioned in his post? What am I missing?

Default Spot on!

Based on the EADs/GC of people I've known this DOES seem like a good rule of thumb.

Whenever there is a sudden movement it is followed by a retrogression or something else new that slows it down. It also happens the other way around so ya, you are spot on!

Just a thought. Labor approved on Aug 17th could not have had a chance to apply I140/I485. You may want to consider from at least August 10th or an earlier date for the pending calculations.

I know asking questions is easy and answering is tough. Believe me i researched and then bothering you. After reading your reply i got a question what happens if I140 is not filed after 140 days, will it become withdrawn? (not all employer might request to withdraw right?

Updated: I thin i found answer in Voicerj reply. Looks like we can not find who did not applied for I140. Thanks voicerj.
