Consular processing makes sense for EB2 I in 2012 than any other year. I believe for a lot of people it will reduce wait time by a year or even more.

These are the number of applications approved for all countries for respective years.

Number of Approved Applications(Perm Applications) for all countries, all categories per year.

2006 ~ 100000
2007 ~ 74000
2008 ~ 59000
2009 ~ 38015 ( Available data, some more added with 2011 perm data)
2010 ~ 16756 ( Available data, some more added with 2011 perm data)

Does any one know what was the spill over for all these years??? Was it any good spill over applied in 2008 and 2009???

This will not give you clear picture of expected demand, you need to look at PERM approvals by PD (or CY) instead of FY.

Not all PERM cases will get certified in the same FY they are applied.

Just as an example, out of your ~59k PERM certifications in FY2008, 25K are PD2007.

I have a question to all the gurus ....

Why is it that the dates wont move till May 2012?

Does that also mean that the EB2I will stay on "15APR2007" till May 2012?

I know that. I looked at all files available until 2010 and combined 2008 cases from 2008 file, 2009 file and 2010 file. I did this same with every year. My question is something and your answer is something else.

Why don't you update your information???

I'm not a Guru but I'll try and answer your question. Per the law, USCIS cannot allot more than 27% of the alloted visas for that year in a quarter. For India that would be a small number . USCIS already has a demand of about 8000 (I+C). Hence the demand is much higher than the supply.

What might happen by May is that the CO can identify that there are a huge number of unused visas from EB1 (like it happened this year) and may choose to take in more demand to meet the supply. This however can happen after he has reasonable confidence that there are many unused visas (supply is more than the demand), and to establish that confidence it will take atleast 6-7 months (Oct to Apr).

I hope it answers your question.

The trend is as follows.

2009 - India got 11K AFAIK so I +C is 14K.
2010 - 26.5K
2011 - 32K (27 is the reduction in demand data itself), 6K could be PWMB and porting.

This looks strange. Market improved from 2009 to 2011. How come we got more spill over. Does this tell anything how it would be for 2012 and going forward??
