congress is already deliberating way too much on HR 3012 which does not increase any thing but merely make the system fair. do u really think we can expect congress make all categories current ? The problem with making it current is that a lot of people will get their GCs out of turn.

This has been mentioned in this forum before --- once 485 is filed, the PD no longer applies, it is the receipt date that applies and everything is FIFO (first in, first out).

So, theoretically, if they made it current, someone with a November 2011 priority date who was able to get his papers in before a guy who has a February 2009 priority date will get his GC first.

The CO trying to avoid doing this. That why they are opening up the VB a little at a time.

Making the date current has nothing do with Congress. It is not a congressional function.

According to the rule book, I thin it stipulates that if demand data < 2800 for any particular category, they have to make the date current.

But the State Department can do whatever it likes. We are after all their mercy.

Default after I-485 filling, if you without job then what happen?

have question,
once you file I-485, and i asked to my desi company , i want to take leave for month, he said you can not leave, because it can impact GC, what i understand, once we apply I-485 , then we can take leave, because after that we dont need to worry out of status?

Default Question on Medical Certificate

I am currently in India on a vacation and my dates are current as of Jan 1st. Does anyone know if the vaccinations listed as a requirement for Medical certificate be taken in India? Will I be able to show a letter from the doctor in India and get a certificate from the civil surgeon in U.S?

Do titer blood test for mmr , vericilla , tdap if needed take them there. Flu too. Check with doc about mmr and ppd test. I read that there should be 4-6 weeks time between two. And u will be doing ppd here so donot take mmr if not taken already.

So if you think your date is going to be current in few months, think again....

They have to clear all these 65K before they move dates further. U will be damn lucky if they still move dates further.

This calculation is based on labor data files from flcdatacenter.com. So it does not consider multiple perm applications by same person, drop outs.

Do not try to repeat the same process and post them here. Everyone of us can do these calculations as we all are high skilled.

With this number if we get 25K spill over every year, it will take 2 years for them to move anything further.

manchala - one could argue that performing all these calculations is futile, because none of our calculations are supported by what the VB did the last time around.

It is impossible that PERMs in 2009 is greater than 2008. All indicators are that demand destruction and everything else is at play.

You suggest that everyone can calculate this..and yet, the purpose of this thread is to have open dialogue regarding calculations.

What is your point?

You are right. Especially after we have been talking to officials and know the discussions. These kinds of calculations and predictions are nowhere in the discussion, but still people waste time everyday on it and make money from it. It's their time and they are mature to make decisions on how to spend their time.

A word of advice to everyone that got current in January. Apply 485 as soon as possible. We are yet to discuss future movement based on December filings so cannot be confident about feb yet. But make use of the January window to file your paperwork. Surprisingly not many had filed until last month.
